Fail, fiili gerçekleştirdiği esnada mağdurların sayısı ve/veya kimliğine ilişkin net bir bilgiye sahip olmayabilir. Çalışmaya konu olan Yargıtay Ceza Genel Kurulu kararında da merciler arasında tartışılan ilk sorun; failin mağdurların bulunduğu araca seri şekilde ateş ettiği bir durumda, araçtakilerin kimliği ve sayısına ilişkin bilgisinin kesin olmaması halinin failin kastı üzerinde nasıl bir etki doğuracağıdır. Mahkeme ikinci olarak ilk soruna ilişkin yaptığı tespit doğrultusunda kasten öldürme suçunun tasarlayarak işlenmesi nitelikli halinin (TCK m. 82/1-a) uygulanabilirliğini değerlendirmiştir. Çalışmada karara konu olan olay incelendikten sonra, bu olayın gerçekleşebileceği farklı ihtimallerde ceza sorumluluğu tespitinin nasıl yapılacağı değerlendirilmiştir. Verilen ihtimallerde tasarlama nitelikli hali ile olası kast, hata ve teşebbüs hallerinin bir arada bulunduğu durumlar ele alınmıştır.
Analysis of the Court of Cassation General Assembly of Criminal Chambers’ Decision ( Decision No. 2021/56) regarding the Qualified Commitment of the Crime of Intentional Killing by Premeditation
The perpetrator may not have clear information about the number and/or identity of the victims at the time of the act. The first problem discussed among the authorities in the decision of the Court of Cassation General Assembly of Criminal Chambers, which is the subject of this study; In a situation where the perpetrator shoots at the victim’s vehicle in rapid succession, how will the uncertainty of the mind of the perpetrator on the identity and number of the occupants in the vehicle aff ects mens rea. Secondly, in line with its determination regarding the first problem, the court evaluated the applicability of the qualified case of intentionally committing the crime of killing with premeditation (TPC Art. 82/1-a). After examining the event that is the subject of the decision in the study, it is evaluated how to determine the criminal responsibility in diff erent possibilities that this event may occur. In the given possibilities, the situations in which the qualified state of premeditation with probable intent or error or attempt coexist are discussed.
