Dijital Çağda Fikri Mülkiyet Hakları ve Akıllı Telefonların Patent Savaşları: Kim Kazanıyor Kim Kaybediyor

Günlük yaşam pratiklerini büyük ölçüde değiştiren akıllı telefonlar son yıllarda büyük patent savaşlarına sahne olmuştur. Akıllı telefonların patent savaşları teknik açıdan dikkatleri yazılım patentlerine yönlendirirken ekonomi politik açıdan Amerikan hegemonyasının korunmasıyla ilgili görülmektedir. İşletim sistemlerinin yanı sıra akıllı telefonların kullanıcısına sağlamış olduğu uygulamalarla ABD teknolojik egemenliğini sürdürmektedir. Akıllı telefonlar daha fazla ürün ve hizmet sundukça daha fazla kullanıcı tarafından tercih edilmektedir. Akıllı telefonların çeşitli platformları ve hizmetleri içerecek biçimde geliştirilmesinin bir nedeni de kullanıcıların masaüstü cihazlara bağlı kalmak yerine kullanıcının her yerde sosyal paylaşımda bulunmalarını sağlamaktır. Akıllı telefonlar bir taraftan piyasa egemenliği için patentleri kullanırken diğer taraftan ABD hegemonyasının sürdürülmesinde araç olmaktadır. Bir anlamda patentler kapitalist sınıflar tarafından denetlenmekte ve sermayenin artırılmasında önemli bir araç olmaktadır. Akıllı telefonların sahip oldukları işletim sistemleri, yazılımlar ve platform teknolojileriyle nasıl hegemonya oluşturduğu, bu hegemoyanın korunup sürdürülmesinde fikri mülkiyet haklarının rolü ve bir fikri mülkiyet hakkı olan patentlerin sahiplerine sağladığı çıkar ile kamu yararı arasındaki ilişkiyi incelemek bu çalışmanın amacını oluşturmaktadır

Intellectual Property Rights in the Digital Age and Smartphone Patent Wars: Who is Winning and Who is loosing?

Smartphones that have changed the practices of everyday life to a great extent have been the scene of major patent wars in recent years. As the smartphone patent wars have technically drawn attention to the software patents, in political economy approach it is seen as a kind of American hegemony. The US continues to be technologically dominant, with applications that smartphones have provided users with operating systems. Smartphones are preferred by more users as they offer more products and services. One reason for the development of smartphones to include various platforms and services is to enable the user to have access to social sharing everywhere instead of being connected to desktop devices. As smartphones use patents for market domination from one side, the other side is the means for sustaining US hegemony. In fact patents are controlled by capitalists and are important means of increasing capital. Thence the aim of this study is to analyze how the smartphones make hegomony with their operation systems, softwares and platform technologies, the role of intellectual property rights in the protection and maintenance of this hegemony, and the relationship between the interests of the patent owner and the public good
