CURRENT DEVELOPMENTS ON ARTIFICIAL INTELLIGENCE AND LIABILITY FOR ROBOT CAUSED DAMAGES

Bu makalede, robotlar ve yapay zeka kavramları incelenmektedir. Bu kapsamda, güncel teknolojik gelişme ve olaylar, konuya ilişkin güncel hukuki çalışmalar ele alınacaktır. Özel olarak ise, robotların verdiği zararlardan dolayı üretici, satıcı ve kullanıcı gibi kişilerin sorumlulukları incelenecektir. Hukuki incelemeler yapılırken, esas olarak Alman Medeni Kanunu ve İsviçre Borçlar Kanunu ile birlikte, İsviçre Medeni Kanunu-Borçlar Kanunu’nu iktibas etmiş olan Türk kanunlarını ve bu ülke doktrinlerini esas alacağız. Ve robotlar konusunda genel hukuki prensipler ortaya koymaya çalışacağız. Konunun çeşitliliğini ve önemini ortaya koymak için, yapay zekaya sahip sistemler ile ilgili son gelişmeler, somut olaylar ve hukuki çalışmalar da incelenecektir.

CURRENT DEVELOPMENTS ON ARTIFICIAL INTELLIGENCE AND LIABILITY FOR ROBOT CAUSED DAMAGES

In this article, robots and artificial intelligence concepts will be examined.In this context, up-to-date technological developments and current legalissues related to the subject will be discussed. In particular1, liabilities ofpersons such as producers, developers, sellers and users will be discussed. Inthe course of legal reviews, we will mainly comply with the German CivilCode “BGB: Bürgerliches Gesetzbuch”, the Swiss Civil Code “ZGB:Schweizerisches Zivilgesetzbuch” and Swiss Code of Obligations “OR:Obligationenrecht” together with the Turkish Civil Code “TMK: TürkMedeni Kanunu” and Turkish Code of Obligations “TBK: Türk BorçlarKanunu” (which have adapted from the Swiss Civil Codes) and the doctrinesof these countries2. Then, we will work to set out a plan on general legal principles about related issues. In order to show the variety and importanceof the subject, there will be examples from latest artificial intelligencesystems, concrete cases and legal works.
