YAPAY ZEKÂNIN BULUŞLARININ PATENTLENMESİ

Günümüzde robotlar, insansız hava araçları, insansız otomobiller, bulut bilişim ve nesnelerin İnterneti başta olmak üzere teknolojik gelişmelerle ilgili haberler sıklıkla gündeme gelmektedir. Bu teknolojik gelişmelerden bir tanesi olan yapay zekânın günlük hayatımızda ve elbette hukuki düzenlemelerde büyük değişikliklere neden olacağı açıktır. Yapay zekânın zaman içinde medeni hukuk, ceza hukuku, sorumluluk hukuku ile ilgili düzenlemeleri etkileyeceği öngörülmektedir. Yapay zekânın etkileyeceği alanlardan bir tanesi de fikri mülkiyet haklarıyla ilgili düzenlemelerdir. Yapay zekâlı makinelerin yaptığı buluşlarda patent hakkı sahibinin kim olması gerektiği çözülmesi gereken karmaşık bir sorundur. Çalışmada öncelikle yapay zekânın ne olduğu açıklanmış daha sonra yapay zekânın buluş yapması halinde buluşçunun kim olacağı hakkındaki tartışmalara ver verilmiştir. Son olarak patent hukuku alanında futuristic/gelecekçi bir yaklaşımla nasıl düzenlemeler yapılması gerektiğine değinilmeye çalışılmıştır.
