Orantılılık ilkesi ve uluslararası insancıl hukuk

Uluslararası İnsancıl Hukuk, silahlı çatışma ve savaş hallerinde uygulanarak, aşırı şiddet kullanılmasını engellemek amacındadır. Bu dala ait önemli hukuk ilkelerden birisi de “orantılılık” ilkesidir. Bu ilkenin de amacı nihai olarak silahlı çatışmalar sırasında şiddeti kısıtlamak, “şiddet için şiddet” uygulanmasının önüne geçmektir. Bu çalışmanın amacı bu ilkenin incelenmesidir. Bu inceleme sırasında, Uluslararası İnsancıl Hukuk’a ve özelde de orantılılık ilkesine yöneltilen bazı eleştiriler de ele alınacaktır.

The principle of proportionality and international humanitarian law

Humanitarian Law’s main objective is to prevent excessive or random and indiscriminate use of violence during wars and other armed conflicts. One of the main principles of Humanitarian Law is “The Principle of Proportionality”. This paper endeavors to examine this principle in detail. During this, probe; I will try to tackle some of the critique raised by thinkers like David Kennedy and Carl Schmitt.
