PARENTAL CHILD ABDUCTION IN EUROPEAN UNION IN THE LIGHT OF THE EUROPEAN COURT OF JUSTICE'S JUDGEMENTS

Uluslararası evliliklerin sona ermesinin en endişe verici sonuçlarından biri olarak ortaya çıkan ebeveynlerin çocuk kaçırması vakaları, bu çalışmanın konusunu oluşturmaktadır. Bu çalışmada, çocuk kaçırma vakalarında çocuğun geri dönmesine ilişkin kurallar, Avrupa Birliği Adalet Divanı ve İngiliz Mahkemeleri kararları ışığında, ilk olarak 1980 tarihli Lahey Sözleşmesi çerçevesinde ele alınacak daha sonra konuya ilişkin Avrupa Birliği üyesi ülkeler arasında daha kapsamlı bir koruma sağlayan Brüksel II Tüzüğü hükümleri incelenecektir.

The foregoing study aims to explore the cases of child abduction by parents, which is one of the most alarming consequences of the breakdown of international marriages. The study examines the rules regarding the return of the child in cases of child abduction in the light of the European Union Court of Justice and the decisions by the British courts, and primarily within the framework of the Hague Convention of 1980. Subsequently, the provisions of Brussels II Regulation which provides a more comprehensive protection within the members of the European Union with regard to the subject matter of the foregoing study is addressed.
