YARGITAY 17. HUKUK DAİRESİ’NİN 2019/3292 E., 2021/1848 K. SAYILI ZORUNLU MALİ SORUMLULUK SİGORTASI KAPSAMINDA TAZMİNAT HESAPLAMASINDA KULLANILAN YÖNTEME İLİŞKİN KARARININ DEĞERLENDİRİLMESİ
Anayasa Mahkemesi’nin 17/7/2020 tarihli ve E.: 2019/40, K.: 2020/40 sayılı Kararından sonra Yargıtay, bakiye ömrün belirlenmesinde TRH-2010 tablosunun esas alınması gerektiği, ancak hesaplamalarda progresif rant yönteminin kullanılması ile bilinmeyen (işleyecek) devredeki gelirlerin her yıl için % 10 artırılıp % 10 iskonto edilmesi suretiyle tazminat miktarının tespit edilmesi gerektiği yönünde karar vermiştir. Yargıtay’ın bu içtihadı, 2918 Sayılı Karayolları Trafi k Kanunu’nun (KTK) 90. maddesi 09/10/2020 tarihli Resmi Gazetede yer alan Anayasa Mahkemesi’nin 17/7/2020 tarihli ve E.: 2019/40, K.: 2020/40 sayılı Kararı ile, bu maddenin birinci cümlesinde yer alan “…ve bu Kanun çerçevesinde hazırlanan genel şartlarda…” ibaresinin ve ikinci cümlesinde yer alan “…ve genel şartlarda…” ibaresinin Anayasa’ya aykırı olduğuna ve iptaline karar verilmesi üzerine geliştirilmiştir. Ancak Anayasa Mahkemesi’nin KTK. m. 90 hükmü yönünden verdiği karardan dolayı Yargıtay’ın geliştirdiği içtihadın sigorta hukukuna hakim olan gerçek zarar ve zenginleşme yasağı ilkeleri çerçevesinde değerlendirilmesi gerekmektedir. Anayasa Mahkemesi kararı neticesinde trafi k sigortasından kaynaklanan tazminatların Genel Şartlara göre hesaplanamayacağı sonucuna varılarak, tamamen aktüerya bilimi açısından değerlendirilmesi gereken bir hususta sigorta hukuku ilkeleriyle çelişir bir içtihat oluşturulmuştur. Bu çalışma ile aktüerya bilimi ilkeleri çerçevesinde, Yargıtay’ın benimsediği progresif rant yöntemine göre hesaplama yapılmasının uygun olup olmadığı incelenecektir.
Evaluation of the Decision of the 17th Civil Chamber of the Court of Cassation Numbered 2019/3292 E., 2021/1848 K. Regarding the Method Used in the Calculation of Compensation within the Scope of Compulsory Liability Insurance
After the decision of the Constitutional Court dated 17/7/2020 and numbered E.: 2019/40 and K.:2020/40, the Court of Cassation decided that in compensation calculation, TRH-2010 should be the basis while determining the estimated remaining life, but the compensation should be determined by using progressive rent method by increasing the income by 10% and then decreasing it by 10% for each year in the unknown (working) period. This precedent of the Court of Cassation was developed after, the phrase “…and in the general conditions prepared within the framework of this Law…” in the fi rst sentence and the phrase “…and in the general conditions…” in the second sentence in the article 90 of Highway Traffi c Law No.2918 (KTK), were decided to be unconstitutional and therefore cancelled by decision of the Constitutional Court dated 17/7/2020 and numbered E.: 2019/40, K.: 2020/40, which was published in the Offi cial Gazette dated 09/10/2020. However, due to the decision of the Constitutional Court regarding the provision of article 90 of KTK, the precedent developed by the Court of Cassation should be evaluated within the framework of the basic principles of the insurance law which are actual damage and prohibition of enrichment. The Constitutional Court concluded that the compensations arising from traffi c insurance cannot be calculated according to the General Conditions, instead they should be evaluated entirely in terms of actuarial science. As a result of its decision, The Constitutional Court set a precedent that contradicts the principles of the insurance law. In this study, it will be examined in principles of actuarial science, whether it is appropriate to calculate the compensation according to the progressive rent method adopted by the Court of Cassation.
