ANAYASALAR, SİYASİ KÜLTÜR VE “HAIDA GWAII’NİN RUHU”

Siyasi kültür ve anayasalar arasındaki ilişki, uzun süredir tartışma konusudur. Özellikle derinden bölünmüş toplumlarda söz konusu ilişki daha çok önem arz etmektedir. Siyasi kültürün anayasalar ile ilişkisinde ve buna bağlı olarak anayasal değişimlerde, diğer toplumsal koşuların da etkili olduğu göz ardı edilmeden; bir toplumun siyasi kültürünün, o toplumun anayasasına yansımasının ne ölçüde önemli olduğu, çalışmanın ana sorunsalını oluşturmaktadır. Bu çerçevede, sanat tarihinin önemli yapıtları arasında kabul edilen Haida Gwaii’nin Ruhu isimli heykelin bize anlattıklarından yola çıkılarak, etno-kültürel yapısı çeşitli ve değişken olan toplumlarda yaşanan çatışmalara değinilecek ve anayasal değerler üzerinde yaşanan bu çatışmaların anayasalar aracılığıyla nasıl çözümlenebileceği incelenecektir. Bunun için öncelikle siyasi kültür kavramı üzerinde durulacak; ardından, anayasalar ile siyasi kültür arasındaki ilişki, anayasalarda etno-kültürel kimliklerin tanınması temelinde incelenecektir. Buna ilişkin öğretide ileri sürülen iki temel öneri üzerinde durularak; her iki önerinin de savundukları yaklaşım ve taşıdığı riskler kısaca incelenecektir. Sonuç olarak, anayasacılık penceresinden bakıldığında, özellikle etno-kültürel tanınma taleplerinin anayasalar ile karşılanabilmesinin mümkün olup olmadığı tartışılacaktır.

CONSTITUTIONS, POLITICAL CULTURE AND “THE SPIRIT OF HAIDA GWAII”

The relationship between political culture and constitutions has been a subject of debate for a long time. Especially in deeply divided societies this relationship is more important. With consideration of other social conditions, within the framework of the relationship of political culture with constitutions and accordingly with constitutional changes; the main problematic of the study is the extent to which the political culture of a society is reflected in its constitution. In this context, based on the story of The Spirit of Haida Gwaii sculpture which is accepted as one of the important works of art history, I will discuss the conflicts in societies with various and variable ethno-cultural structures and will examine how these conflicts on constitutional values can be resolved through constitutions. Therefore, firstly, the concept of political culture will be emphasized; then, the relationship between the constitutions and political culture will be examined on the basis of the recognition of ethno-cultural identities in constitutions. With the emphasis on two proposals put forward in the doctrine, the approach and the risks of them will be briefly examined. As a result, it will be discussed whether it is possible to meet the demands of ethno-cultural recognition through constitutions.
