HAKLI SAVAŞ ÖĞRETİSİNİN FİKRİ TEMELLERİ ÜZERİNE BİR İNCELEME

Haklı savaş öğretisi, savaşın hangi durumlar altında haklı olarak kabul edilebileceği üzerine geliştirilmiş olan fikirleri ihtiva eder. Öğreti seküler kaynakları da bulunmakla birlikte, büyük ölçüde Hıristiyan teolojisinden beslenmiş ve Hıristiyanların hangi koşullar altında haklı olarak savaş verebileceklerinin çerçevesini çizmiştir. Bu çalışmada bir savaşın haklı olarak verilebilmesine ilişkin fikri öncüllerden başlanarak, haklı savaş anlayışının bir öğreti durumuna gelişi ve modern döneme geçişi incelenmektedir. Bu doğrultuda haklı savaşın öncüllerini temsilen Cicero ve Ambrose; bir öğreti durumuna geçişini sağlayan düşünürler Augustine ve Aquinas, son olarak da öğretinin modernleşmesini simgeleyen düşünürler olan Vitoria, Suarez ve Grotius'un haklı savaşa ilişkin görüşleri ele alınmaktadır

AN INVESTIGATION ON THE INTELLECTUAL FOUNDATIONS OF THE JUST WAR DOCTRINE

The just war doctrine incorporates the thoughts developed in order to deal with the issue of under which conditions a war is accepted as just. Although the doctrine has secular roots, it has been substantially fed by Christian theology and it draws a frame for just war for Christians. This study starts with the intellectual antecedents of just war and investigates the process of how it is turned out to be a doctrine and its’ transformation into the modern era. While doing so, the thoughts of Cicero and Ambrose, representing the intellectual antecedents of just war; of Augustine and Aquinas as the intellectuals providing the foundations of it as a doctrine and of Vitoria, Suarez and Grotius who were modernizing the doctrine will be addressed
