Devlete Yeni Rol: Regülasyon

Son yıllarda birçok ülkede, özellikle kamu hizmeti niteliğindeki mal ve hizmetlerle ilgili sektörlerde, bir düzenleme furyası içine girilmiştir. Bunun nedenleri arasında kamu hizmetlerinde özelleştirme; düzenlemenin gerekliliği ve bu düzenlemenin yararlarının anlaşılmaya başlanması, özel kesim işletmecilerinin hakim durumlarını kötüye kullanmalarına ilişkin endişeler sayılabilir. Girişilen iş aslında hiç de kolay değildir. Etkin bir düzenleme sisteminin kurulması ve işletilmesinin zorluğu ve bir öğrenme sürecini gerektirmesi bir tarafa; Türkiye gibi gelişmekte olan ülkelerde bu anlamda düzenleme geleneğinin bulunmaması, uzmanlığın mevcut olmaması, karşılaşılan zorluklardan sadece bir kaçıdır. İşte bu makalenin amacı, regülasyon konusunu hukuk ve ekonomi disiplini çatısı altında ele alarak, yukarıda değinilen konu ve sorunlara yönelik olumlu bir katkıda bulunmaktır.

A New Role to the State: Regulation

Recently, there has been an extraordinary rush in regulatory activities especially in public goods and service sector in most of the countries, this has occurred mostly as a result of privatization in the utilities sector, the increased awareness of the need for and benefits of such regulation, and the recognition of the need both to concerns about monopolistic abuses by private operators. The challenge is considerable, not only due to the complexity underlying the establishment and the operation of an effective regulatory system, but also because of the lack of a regulatory tradition and track record, scarcity of expertise, all so prevalent in developing countries such as Turkey. Aim of this article is to provide positive contribution to the above mentioned subjects and problems by taking the regulation topic in the discipline of law & economics.
