CARL SCHMITT: İSTİKRARDAN ‘İSTİSNA’YA SİYASAL DÜZEN

Siyasal olanın yeniden düzenlenmesi ‘karar’a dayalı olması itibariyle hukukla doğrudan ilişkilidir. Olağanüstü hal marjinal olaya indirgenemediğinden ve kurucu vasfı nedeniyle kritik önemde kendini gösterir; Schmittyen terminolojiyle bu durum istisna halidir. Modern devlet için istisna hali Schmitt’te liberalizm ile demokrasi arasındaki çatışmanın bir sonucu olarak okunabilir. Demokrasi ve liberalizm teorik olarak dayandığı ilke ve değerler sistemi itibariyle çelişki gösterir. Demokrasi sadece halkın bileşenine eşitlik vaat ederken liberalizm insanlık için teorik eşitliğe dayanır; demokrasi homojenlik ilkesiyle liberalizm heterojenlik ilkesiyle işler. Schmitt için modern demokratik devlet için temel sorun dost/düşmanı tayin etmektir. Devlet aklı kuramı, liberal demokrasi eleştirisi ve politik olan/toplumsal olan ayrımı bağlamında Schmitt çalışmalarının literatürdeki yerinin belirlenmesi amaçlanmıştır. Bu çalışmada bu amaçla Schmitt’in egemenlik kuramı Schmitt’in birincil metinlerini ve Schmitt üzerine yazılan tartışmaların incelenmesini içeren bir literatür taramasıyla açıklanmıştır. Schmitt’in teorik analizi ona yönelik eleştiriler dikkate alınarak yapılmıştır. Bu makalede Schmitt’in kuramının doğu tipi despotik rejimleri değil faşizme kayan liberal demokrasileri açıkladığı tezi ileri sürülmüştür.

CARL SCHMITT: POLITICAL ORDER FROM STABILITY TO 'EXCEPTION'

The rearranging of the political object is directly in relation to the law, as it is based on the ‘decision’. The state of emergency is of a crucial importance since the state of emergency cannot be reduced into a marginal incident and due to its founding qualification, such a status is a case of exception with the pro Schmitt terminology. The exception case for the modern state may be considered as a result of the conflict among the liberalism and the democracy according to Schmitt. Democracy and liberalism do exhibit a contradiction as to their system of principles and values in theory. Liberalism is based on theoretical equality for humanity while democracy only promises to the component of the people. In addition, democracy operates with the principle of homogeneity whereas liberalism operates with the principle of heterogeneity. For Schmitt, the basic matter for the modern democratic state is to determine the friends / enemies. The aim of this paper is to determine the place of Schmitt studies in the literature in the context of the state mind theory, the critique of liberal democracy and the distinction of the political / social area. For this purpose, Schmitt's sovereignty theory is explained by a literature review that includes the primary texts of Schmitt and the examination of the discussions on Schmitt. Theoretical analysis of Schmitt was made by taking into consideration the criticisms towards it. It was concluded that Schmitt's theory explained the liberal democracies that shifted to fascism, not the eastern despotic regimes.
