BİR İŞ KAZASINA BAĞLI YÜZDE SÜREKLİ (DAİMİ) DEĞİŞİKLİK OLGUSU

Yüksekten düşme ile gerçek- leşmiş iş kazalarında, izole göztravmaları oldukça nadirdir. Bumakalede, erkek inşaat işçisi ol- gusu, iş yerinde 2. kattan yerdebulunan kumlar üzerindeki de- mir yığınlarına düşme sonrası,gözüne yerde bulunan bir demirparçasının saplanması sonucuoluşmuş göz enukleasyonu ilehastaneye başvurmuştu. Olguplastik cerrahi tarafından ope- rasyona alınmış ve orbita böl- gesindeki yaralanması, alındanalınan saçlı deri flebi ile kapatıl- mıştı. Olgu olaydan bir yıl sonrapolikliniğimizde muayene edildi.Yüz bölgesinde oluşmuş defor- masyonu ve göz enukleasyonu,yüzünde sürekli değişiklik ve or- gan işlevi kaybı olarak değerlen- dirildi. Bu olgu sunumunda, olayın oluşşeklinin ilginçliğinin ve yüzdesürekli değişiklik vakalarının azgörülmesinin vurgulanmasınınyanı sıra, yüzde sürekli değişik- liğin hukuki boyutu irdelenmiş- tir. Mağdurlara uygulanan suçlailgisiz, etkilerinin değerlendiril- mesi ile suçlulara ek cezai so- rumluluk yüklenmesinin, hak- sızlık olacağını düşünmekteyiz.Bu bağlamda, ceza yasalarındakiağırlaştırıcı unsurların bir kezdaha gözden geçirilmesini veyüzde sürekli değişikliği de kap- sayan bazı ağırlaştırıcı faktörle- rin, bazı ülkelerde olduğu gibiceza yasalarından ziyade tazmi- nat hukuku içinde yer almasınıönermekteyiz.

PERMANENT DISFIGUREMENT OF FACE IN AN OCCUPATIONAL ACCIDENT CASE

The isolated ocular traumas as- sociated with falls from heightconnected with occupationalaccidents are very rare. In thisarticle, male case applied to thehospital with ocular enucleation,result from ocular trauma by en- tering of a piece of iron bar onthe heap of sand on the groundfollowed by to falling from 2ndfloor. The case were operated byplastic surgeons and his ocularwound was repaired with scalpflap taken from frontal region.Case was examined in our poly- clinic after one year from theevent. The deformation occurredin his facial region and his ocu- lar enucleation were evaluatedas permanent disfigurement onthe face and permanent loss ofan organ. In this case report, the legalaspect of permanent disfigure- ment on the facial region was in- vestigated as well as underliningof the interesting in the occur- rence of the event and the rarityof cases about permanent disfig- urement on the face region. Wethink that, the loading to addi- tional penal liability to criminalswith evaluation of the effectsunrelated with crime applied tothe victims, will be injustice. Inthis context, we suggest that,aggravated factors in the penalcodes should be reviewed andsome aggravated factors includ- ing permanent disfigurement onthe face should be located in thecompensation laws rather thanpenal codes as in some coun- tries.
