Telekomünikasyon yoluyla yapılan iletişimin denetlenmesi, Türkiye’de yasal zemine kavuştuğundan beri, son derece tartışmalı uygula- malara konu olmuş bir koruma tedbiridir. Tedbire ilişkin öncelikli mesele, uygulamada yasal koşullara uyulması hususunda yaşanan gönülsüzlük ve dirençtir. Kanunda öngörülmüş olan teminat hükümlerine, şeklen uyulmak suretiyle, güvencelerin içinin boşalması sonucu doğmaktadır. İletişimin denetlenmesi tedbirine ilişkin olarak demokratik toplum hayatı açısından ortaya çıkan bir diğer mesele, yaygın şekilde yapılan denetimlerin, iletişim özgürlüğü ve özel hayatın gizliliği hakkını ciddi bir şekilde zedelemekte olu- şudur. Çalışmada, iletişimin denetlenmesi tedbiri gerek uygulama gerekse, teorik açıdan irdelenerek değerlendirilmektedir.

The rules regarding interception and surveillance of telecommunications, and their application have been controversial since they first gained legal ground. The very first matter observed is the reluctance of officials to follow the due procedure laid out in the relevant legislation. By merely following formalities, the core of the guarantees are weakened. Another problem of interception and surveillance of telecommunications is in relation to democratic society. The growing tendency to resort to these measures, pose a serious threat to the essence of basic civil liberties such as right to privacy and freedom of communication. In this work, the actual enforcement of these measures are assessed, with consideration to their theoretical foundations.
