Yorum davası olarak nitelendirirken ön karar davalarında verilen karar prensip olarak geriye doğru hüküm ve sonuç doğurur ve bunun sonucu olarak da yorumlanan normun ihdas edildiği tarihten itibaren taşıdığı anlamı ortaya koyar. Makalede kararın geriye doğru değil de, verildiği tarihten itibaren ileriye doğru hüküm ve sonuç doğurmasının gerekliliği ve nedenleri açıklığa kavuşturulmaktadır.

Decisions of the European Court of Justice (ECJ) in the preliminary ruling procedures on the interpretation of European law in principle produce retroactive effects from the time at which the law in question came into force and define and clarify the meaning of the law from the date it was published. In this article, the aim is to shed light on why the ECJ’s decision should produce effects from the date it was given rather than to produce retroactive effects.
