CHIEFS OF PUBLIC PROSECUTORS' ADMINISTRATIVE DUTIES AND AUTHORITIES IN TURKEY

Cumhuriyet savcıları, şikâyet üzerine ya da resen suç teşkil eden eylemleri soruşturan kamu görevlileridir. Onların görevleri ülkeden ülkeye ülke geleneğine göre değişmektedir. İngiltere ve Türkiye örneğini ele alırsak, İngilterede şahsi dava prensip olarak uygulanırken, Türkiyede suç teşkil eden eylemler hakkında şahsi dava açma imkânı yoktur.Şayet bir yerde bir grup görevli veya çalışan varsa orada bir gözetmen olmak zorundadır. Gözetmenin görev ve yetkisi ve ismi ülkeden ülkeye değişebilmektedir. İdarede gözetmenin görevi sadece idari iken, yargısal alanda gözetmenin idari ve yargısal görevleri vardır, yargılamaya katılma veya soruşturma ve idare etme. Türkiyede, savcılık alanında bu gözetmenin ismi Cumhuriyet başsavcısıdır ve onun esas olarak idari görev ve yetkisi vardır. Onların görev ve yetkileri cumhuriyet savcısı üzerinde, personel üzerinde veya adliye üzerinde olabilmektedir. Fakat bu görevler ve yetkiler hâkimler üzerinde değildir/olamaz. Yine de adliye yönetimi yetkisi doğal olarak hâkimleri de etkilemektedir. Bu çalışmada, Cumhuriyet başsavcılarının savcılar, personel, bağlı birimler vs ile ilgili sadece idari görev ve yetkileri üzerinde durulmuştur. Türkiyede Cumhuriyet Başsavcılarının İdari Görev ve Yetkileri

Public prosecutors are officers who prosecute criminal events on condition of compliant application or ex-officio. Their authority and duty vary from one country to another, according to their tradition. If we take opposite samples into account, such as England and Turkey, in England actio personalis is principal, whereas it is impossible for criminal events in Turkey. Prosecutors who have the authority of filing a lawsuit before criminal courts work in a group because of their quantity. If there is a group of officers or staffs, there have to be supervisor of course. Supervisors authority, duty and even the title can vary from country to another. In the administrative area, supervisors duty should only be administrative. But in judicial area, there are two duties of supervisors, trial or prosecutional and administrative. In Turkey Supervisors title in prosecution area is called chief of public prosecutors and they have mainly administrative authority and duty. Their duties and authorities involve public prosecutors, personnel and courthouse building. But, they cannot deal with judges. On the other hand, their courthouse management authority can affect judges naturally. In this work, there are only administrative authorities and duties of chiefs of public prosecutors regarding prosecutors, personnel and related branches are examined.
