Haksız rekabet kavramı, Türk Borçlar Kanunu ve Türk Ticaret Kanunu'nda düzenlenmiştir. Belirtilen iki Kanun da yürürlüğe, 2012 yılında aynı zamanda girmiştir. Bunlardan ayrılan bir diğer düzenleme ise, Rekabetin Korunması Hakkında Kanun'dur. Haksız rekabet, Türk Borçlar Kanunu m. 57'de genel bir ilke olarak düzenlenmiştir. Ancak, bu hükmün ikinci maddesinde, Türk Ticaret Kanunu'nun haksız rekabete ilişkin hükümlerinin saklı olduğu belirtilmektedir. Bu çerçevede, çalışmada, belirtilen ayrımın açıklığa kavuşturulması ve Türk hukukunda haksız rekabete ilişkin ilkelerin genel olarak değerlendirilmesi amaçlanmaktadır.

The term of unfair competition is regulated under Turkish Code of Obligations and Turkish Commercial Code. These two Codes entered into force at the same time in 2012. Another regulation, which must be distinguished from these, is the The Act on the Protection of Competition. Unfair competition is regulated under the Article 57 of the Turkish Code of Obligation as a general rule. However, in the second paragraph of this article, provisions of Turkish Commercial Code related to unfair competition are reserved. In this context, it is aimed in this article to clarify mentioned distinction and examine the provisions in Turkish law concerning unfair competition.
