ULUSLARARASI ADALET DİVANININ 9 TEMMUZ 2004 TARİHLİ "DUVAR" KONUSUNDAKİ İSTİŞARİ GÖRÜŞÜNDEN ON YIL SONRA: DİVANIN ULUSLARARASI HUKUKA VE FİLİSTİN MESELESİNE KATKISI NE OLMUŞTUR?

2002 yılında İkinci İntifadan itibaren 2012 yılında Filistin Devleti'nin kurulması kararına kadar geçen zaman içerisinde, kaydedilen gelişmelerin gölgesinde yaşanan önemli olaylardan biri olarak İsrail'in işgal etmiş olduğu topraklarda 2002 yılından itibaren inşa etmekte olduğu "Duvar"dır. Bu konuda istişarî görüş vermeğe çağrılan Uluslararası Adalet Divanı, 9 Temmuz 2004 yılında "Duvar"ın Uluslararası Hukuka aykırı olduğunu bildirmesinden sonra da aradan on yıl geçmesine rağmen, inşaat devam etmektedir. 2004 yılında I-UAD'ı istişarî görüş vermesinde yaşanan hukuki gelişmeleri, bunun hukuki sonuçları ve görüşün verilmesinden on yıl sonra gelinen durumu; II- Divan görüşünün gerek Uluslararası Hukuk alanında gerek UAD'ı içtihadına Devletin uluslararası alandaki sorumluluğu açısından bir yaklaşımla, getirmiş olduğu katkıyı; III-Divan görüşünden itibaren on yıl içerisinde Filistin'de yaşanan gelişmeleri değerlendirmeye çalışacağız.

(TEN YEARS AFTER THE ADVISORY OPINION OF THE ICJ ON THE PALESTINIAN WALL CASE DATED 9TH OF JULY 2004: HOW THIS ADVISORY OPINION HELPED AND CONTRIBUTED TO THE DEVELOPMENT OF THE PALESTINIAN ISSUE, AND THE ICJ'S JURISDICTION?)

During the time period that followed the Second 'Uprising' in 2002, until the decision to establish a Palestinian State in 2012, starting from 2002 on, one of the most important events was the construction of a "Wall" by Israel within the Israel occupied Palestinian territory. The International Court of Justice which was called upon to give an advisory opinion on the matter, decided that the so called "Wall" was against the International Law on the 9th of July, 2004. Even ten years after the decision of the International Court of Justice, the "Wall" is still continuing to be built. Initially, we are going to assess the legal developments that took place during the 2004 Advisory opinion of the ICJ, its legal ramifications, and the current situation 10 years later; and then, the contribution of this ICJ opinion to the responsibility of a State within the International realm, both in regards to International Law, and also for setting a precedent for future ICJ decisions; and finally the developments that took place in Palestine 10 years after the advisory opinion.
