From the state-centric to dual globalist: A paradigm shift in international economic law

Uluslararası eko no mile hukukunun 2. Dünya Savaşı sonrası temelleri atılan niteliği, rolü ve işlevi, 2000'li yıllara doğru yeniden belirlenmiştir. Makale, 1970'li yılların ücinci yarısında gerçekleşen bir paradigma değişimi ile ortaya çıkan ekonomi hukukunun söz konusu yeniden tanımlanmasını incelemektedir. Minimalist devlet ve piyasa ekonomisine vurgu yapan neo-liberal ideolojinin yükselişi ile, 1980'ler sonu ermeden, 1945'ler sonrasına egemen olan devlet-merkeci paradigma ortadan kaybolmuştur. Yerine, bu çalışmada "küreselci" olarak tanımlanan ikili bir paradigma egemen hale gelmiştir. Bu değişim, ulus-devletten çokuluslu şirketlere ve uluslararası ekonomi ve fînaııs kuruluşlarına ekonomik ve düzenleme gücü transferi ile sonuçlanmıştır. Bu makale, uluslararası ekonomik hukukunda yaşanan bu paradigma değişimine konu olan paradigmaların karakterlerini analiz ederken, söz konuu değişimin genel olarak uluslararası hukukun özel olarak da uluslararası ekonomik hukukunun normatif gelişimi üzerindeki olası etkilerini tartışmaktadır.

Devlet-merkezci paradigmadan ikili 'Küreselci' paradigmaya geçiş: Uluslararası ekonomi hukukunda bir paradigm değişikliği

The nature, role and characteristics of international economic law from 1944 to the 2000s have been re-defined.. The article examines this re-definition by means of describing a paradigm shift, which took place in the second half of the 1970s. By the end of the 1980s, with the rise of neo-liberal ideology and its emphasis on the minimalist state and market economy, the state-centric'paradigm vanished from sight. Instead a new dual paradigm, labelled here "globalist", became the dominant paradigm. This shift has resulted in the transfer of economic and regidatoty power from state to MNEs and international economic institutions. This article examines this paradigm shift in international economic law and analyses the characteristics of each paradigm with a view to understand the nature and direction of the paradigm shift and its possible impacts on the normative development of international law in general and international economic law in particular.
