FRANSIZ HUKUKUNDA KİŞİSEL VERİLERİ KORUMA OTORİTESİ: CNIL

Türk hukukundaki "düzenleyici ve denetleyici kurumlar" listesine 2016 yılında katılan Kişisel Verileri Koruma Kurumu'nun Fransız hukukundaki muadili, "Commission nationale de l'informatique et de libertés" - CNIL - ("Bilişim ve Özgürlükler Ulusal Komisyonu") adlı kurumdur. Fransız hukukunda "bağımsız idari otorite" statüsünde kurulan ilk kurum olan CNIL, 1978 yılındaki kuruluşundan bu yana kişisel verilerin korunması alanında yaklaşık 40 yıldır görev yapmaktadır. Komisyonun oluşumuna ilişkin düzenlemeler incelendiğinde, bağımsız ve tarafsız karar almayı sağlayacak önlemlerin yanı sıra, kadın ve erkek üyelerin sayısı bakımından temsilde eşitliğin sağlanması kaygısıyla da hareket edildiği görülmektedir. Görev ve yetkileri incelendiğinde ise, CNIL'in kişisel verilerin korunmasını sağlamaya yönelik, izin vermek, genel düzenleyici işlem yapmak, yaptırım uygulamak gibi yetkilerinin bulunduğu görülmektedir. Ancak bu yetkilerden çok daha dikkat çekici olan, teknolojik gelişmelerin kişisel veriler üzerindeki ileriye dönük etkisine ilişkin öngörülerde bulunma ve gerekiyorsa önlem alma amacıyla yürüttüğü faaliyetlerdir.

THE FRENCH DATA PROTECTION AUTHORITY: CNIL

The Turkish "Board of Personal Data Protection" which joined the list of "regulatory and supervisory institutions" in Turkish law in 2016, is the equivalent of the institution named "Commission nationale de l'informatique et de libertés" - CNIL ("National Commission on Informatics and Freedoms") in French law. CNIL, being the first institution established under the "independent administrative authority" position in French law, has been serving in the field of personal data protection for 40 years since its foundation in 1978. When the regulations on the formation of the Commission are examined, it is seen that, besides the measures taken to ensure the making of independent and impartial decisions, careful consideration is given to the ratio of male to female members in terms of maintaining gender equality in representation. When its duties and authorities are examined, it is observed that CNIL has authorities such as empowering, performing general regulatory procedures and enforcing sanctions for the protection of personal data. However even more striking than these are the activities it carries out with the aim of foreseeing and when necessary, taking action on the effects of cutting-edge technological developments on personal data.
