2003 yılında imzalanan ve 2006 yılında Türkiye tarafından kabul edilen UNESCO Somut Ol- mayan Kültürel Mirasın Korunması Sözleşmesi (bundan sonra Sözleşme olarak anılacaktır) kültürel mirasın korunması konusunda nesnelerin yanı sıra onu üreten ve kuşaktan kuşağa aktaran insanın rolüne vurgu yaparak bilinen ezberleri bozmuş ve sivil toplumun önemini gündeme getirmiştir. Toplu- luk, grup ve kimi durumlarda bireylere verilen bu önem hem Sözleşme metninde hem de Sözleşmenin uygulama aşamasında faydalanılmak üzere oluşturulan Uygulama Yönergesi ve Etik Prensipler gibi destek metinlerde ele alınır. Bunun yanı sıra Sözleşme kapsamında oluşturulan İnsanlığın Somut Ol- mayan Kültürel Mirası Temsilî Listesi ve Acil Koruma Gerektiren Somut Olmayan Kültürel Miras Listesine bir unsurun kaydedilebilmesi için ilgili Taraf Devlet’in yerine getirmesi gereken şartlardan biri de topluluğun mirasın korunması sürecine katılımıyla ilgilidir. Herhangi bir unsurun ilgili top- luluğun, grubun veya bireylerin mümkün olan en geniş katılımı ve özgür ve önceden bilgilendirilmiş rızası ile aday gösterilmiş olması her iki liste için de vazgeçilmez ölçütlerden biridir. Sözleşmenin in- sanı merkeze alan bu yaklaşımı kâğıt üzerinde hatasız ve birbirini tamamlar görünmektedir ancak Sözleşmenin uygulama aşamasında bunun ne kadar geçerli olabildiği veya olamadığı ise tartışmalı bir konudur. Özellikle bahsi geçen iki listeye aday gösterilen unsurların listeye kaydedilmesinde ilgili kri- terin uygulanması, listeler arası unsur transferlerinde topluluğun katılımının önemi, listeden bir un- surun çıkarılmasında topluluk, grup ve bireylerin rızası, listeye kaydedilen bir unsura sivil toplumdan gelen itirazlar gibi konuların bulanıklığı Sözleşmenin uygulama aşamasında soru işaretlerine neden olmaktadır. Bu makalede Somut Olmayan Kültürel Mirasın Korunması Sözleşmesinin katılımla ilgili dikkati, İnsanlığın Somut Olmayan Kültürel Mirası Temsilî Listesi ve Acil Koruma Gerektiren Somut Olmayan Kültürel Miras Listesi üzerinden verilen örneklerle sorgulanmış ve uygulama ile Sözleşme arasındaki ilişki tartışılmıştır.

Signed in 2003 and 2006 adopted by Turkey UNESCO Convention for Safeguarding Intangible Cultural Heritage has distorted the known memorization and raised the importance of civil society, with an emphasis on the role of the human being, who produces and transfers it from generation to generation, as well as objects on the preservation of cultural heritage. This importance is given to the community, group and, in some cases to individuals is included in the text of the Convention as well as in the support texts created to benefit from the implementation phase, such as the Operational Directi- ve and the Ethical Principles. Moreover, one of the conditions that must be fulfilled by the State Party concerned is the participation of the community in the heritage conservation process in order to an element is to be inscribed in the Representative List of the Intangible Cultural Heritage of Humanity and List of Intangible Cultural Heritage in Need of Urgent Safeguard created under the Convention. It is one of the indispensable criteria for both lists that any element, community, group, or individuals are nominated by the widest possible participation and free and pre-informed consent. This perspective based human of Convention seems to be complete and complementary however, it is controversial whet- her or not this is valid at the implementation stage of the Convention. The blurring of issues such as the application of the relevant criteria in the listing of the elements nominated for the two lists listed, the importance of the participation of the community in the inter-item element transfers, the consent of the community, the groups and individuals in the elimination of an element from the list, the objec- tions from the civil society to the list, the questioning of the implementation of the Convention. it is. In this article, the attention of the Convention on the Protection of the Intangible Cultural Heritage was examined with the examples given on the Intangible Cultural Heritage List of Humanity and the List of Intangible Cultural Heritage in Need of Urgent Safeguard and the relationship between the imple- mentation and the Convention was discussed.
