Uluslararası Hukukun Teorik Kaynagı Olarak Temel Norm ve Tanıma Kuralının Degerlendirilmesi

Bu makalenin amacı, uluslararası hukukun kaynağı olarak sırasıyla Kelsen ve Hart tarafından öne sürülen temel norm ve tanıma kuralı kavramlarını değerlendirmektir. Bu değerlendirmenin neticesinde hangi kavramın ve bu kavramlara ilişkin hangi düşünürün teorisinin uluslararası hukukun niteliği ile daha çok bağdaştığı ortaya konmaya çalışılacaktır. Bu amaç doğrultusunda Kelsen'in temel norm ve Hart'ın tanıma kuralı kuramları ana hatlarıyla incelenecek ve bu kavramlara yöneltilebilecek olan eleştiriler ele alınacaktır. Ancak, buradaki amaç, bütün olarak temel norm ve tanıma kuralı kavramlarına yöneltilen eleştirilerin bir dökümünü sunmak değil, söz konusu eleştirilerin bu kavramların uluslararası hukukun kaynağı olma niteliğini de etkileyeceğinin düşünülmesidir.

Evaluation of the Basic Norm and the Ruleof Recognition as the Theoretical Source ofInternational Law

The purpose of this article is to evaluate the concepts of the basic norm and the Rule of Recognition developed consecutively by Kelsen and Hart. The motivation behind such evaluation is to reveal which concept and theory related to these concepts are more suitable for the nature of the international law. Bearing these purposes in mind, Kelsen's theory of the basic norm and Hart's understanding of the Rule of Recognition will be examined in broad strokes and criticism of these concepts will be investigated. However, this investigation is not to provide a full account of the criticism surrounding the basic norm and the Rule of Recognition, but the fact that these criticisms may affect the concepts' aptness as the basis of international law.
