ÖZ Bazen bir hukuki metinde bir çok iş veya isim sıralanır. Bu sıralamaya İslam hukukunda "Tertib" denir. Tertibin arap toplumuna özgü genel nedenleri olduğu gibi İslam hukukunda da özel nedenleri vardır. Araplar genellikle, sıralayacakları şeyleri manaları itibariyle ( zaman, konum, sebep-sonuç ilişkisi vb) değerlendirerek aralarında bir tertib oluştururlar. Bunu da dillerinde bulunan ve sıralamayı bildiren bağlaçlarla ifade ederler. İslam hukukunda ise, İslam hukukçuları temel kaynaklar olan Kur'an ve Sünnet'ten hüküm çıkarırken, bu bağlaçlara çok dikkat etmişlerdir. Çünkü eğer metinde, sıralamayı (tertibi) bildiren bir bağlaç kullanılmış ise, sıralanan şeylerin o sıraya uygun yapılması gerekir. Metinde sıralamayı bildiren bir bağlaç kullanılmamış ise, peygamberin uygulamasında bu sıraya daima riayet edilip edilmediğine özellikle dikkat etmiş ve ona göre hüküm çıkarmışlardır. Bu uygulamada da bir ipucu bulunmazsa, kendileri sıralanan şeylerin hukuki konumlarını tespit ederek aralarında bir tertib oluşturmuşlardır

ABSTRACT In judicial texts sometimes the words are strung together and this type of writing is called 'Tertib'in Islamic law. Tertib plays a special role for the arabs, however it plays also an important role in the Islamic law. In Arabic the position of the verbs depend on their importance and meaning (time, status, reason-conclusion) and thus 'Tertib' is applied, and conjunctions indicate the order of verbs. those conjunctions were paid attention to when Islamic lawyers enforced a judgment and there the Coran and Sunnet were the main sources for their judgments. here it was important to enforce the judgment according to the sequence of the verbs when there is a special conjunction emphasizing its order. in passages where indicative conjunctions were not used then attention was paid to the judgments order of the prophet. Islamic lawyers tried to figure out the judicial status of the matter and created their own 'Tertib' unless there was any prove indicating that the prophet has enforced the judgment by the verbs order.
