Hukukta duyguların dirilişi

Geleneksel anlayışa göre, duygular akılla bağdaşmazlar ve bundan ötürü de elden geldiğince onların düşüncesürecinde devre dışı kalmaları gerekir. Hukuk bilimi de teorik olarak akıl vasıtası ile normları keşfedip bunlarıpozitif olarak düzenleme çalışması olduğundan, hukuki normların ve kararların duygulardan arındırılmasıgerektiği ileri sürülmektedir. Bu çalışmada bu yaklaşımı sorgulamak amacıyla temelde duygularla hukuk ilişkisimercek altına alınırken, aynı zamanda genel hatları ile akıl ve duygu ilişkisi analiz edilmektedir.Bu çalışmada ortaya çıkmıştır ki, insan aklı aslında daha bilinç düzeyine çıkmadan önce bir takım bilinçaltıduygusal muhakeme sürecinden geçerek şekillenmektedir. Bunun sonucu olarak da akıl ile duygularınbirbirlerine zıt unsurlar olmadıkları ortaya çıkmaktadır. Akıl sayısız duyguların çarpışması sonucunda su yüzünevuran duygular bileşkesidir. Hukukun üstünlüğü, adalet ve eşitlik kavramlarının ortaya çıkmasının ve bunlarınhayatta kalmalarının temelinde, insanın otorite ile ve birbirileri ile olan ilişkilerinde gizli olan duygularyatmaktadır. Öyle ise sonuç olarak denebilir ki, genel olarak hukuksal kavramların özünde gerçek hayatta yaşayan insanlarınduyguları vardır. Bu realite, bizi şu sonuca götürür: Somut pozitif normlar dediğimiz anayasa, kanun, tüzük,yönetmelik ve uluslararası antlaşma ve normlar duyguların ahenkleşmiş şeklidir. Bunlar hem duygular temelindeortaya çıkarlar, hem de uygulamada duyguları etkileyip yönlendirirler. Dolaysıyla burada, hukukta duygularındirilişine şahit oluyoruz.

Resurrection of emotions in law

According to the traditional understanding, emotions do not get along with the reason very well and because ofthat they should stay off of the thinking process as much as possible. As, theoretically, also the science of law isthe work of the discovering the norms by means of reason and positively regulation of them; it is put forwardthat the legal norms and decisions ought to be cleaned of from emotions. In order to put this approach inquestion, the relation between emotions and law at one side and at the same time the relation between reason andemotion has been analysed at the other side.In this study, the fact that the human reason is being shaped through the way of some subconscious reasoningprocesses even before they erupt into the consciousness has emerged. And as a consequence of that it becomesclear that the reason and the emotions are not the contradicting elements. Reason is the combination of emotionshitting the surface after the confrontation of countless feelings. At the bottom of the emergence and existence ofthe terms like the rule of law, justice and equality lies the in relations of human beings with the authorities andhidden emotions.If that is the case, as conclusion it can be said in general that in the essence of legal norms there are emotions andfeelings of the human beings who lead the daily real life. This reality lead us to that conclusion: so calledpositive norms like constitution, statute, regulations or bylaw, ordinances and international agreement and normsare the harmonized forms of emotions. These come into being on the basis of the emotions as well as in practice,they affect and steer the emotions. Thus here, we are witnessing the resurrection of emotions in law.
