BM’de Irksal Ayrımcılık Yasağı, Erken Uyarı ve Soykırım Suçunun Önlenmesi

Irksal Ayrımcılığın Bütün Biçimlerinin Sona Erdirilmesine İlişkin Uluslararası Sözleşme, uluslararası insan hakları hukukunda ırksal ayrımcılık yasağının en kapsamlı normatif temelini oluşturur. Sözleşme ile kurulan Komite, taraf devletlerin raporlarını, devlet başvurularını ve bireysel başvuruları inceleme, görüş ve genel yorum/tavsiyelerde bulunma gibi BM'de insan haklarının korunmasında antlaşmatemelli mekanizma organlarının "klasik" yetkilerine sahiptir. Komite, bu yetkilerin yanı sıra, Sözleşmenin konu ve amacına uygun bir biçimde, 1993'te, "erken uyarı ve acil eylem" usulü benimsemiştir. Bu usulün amacı, Sözleşme ihlallerinin çatışmaya ve ağır, kitlesel veya sürekli ırksal ayrımcılık pratiklerine dönüşmeden önce sona erdirilmesine katkıda bulunmaktır. Komite 2005'te de, BM çerçevesinde geliştirilen "soykırımı önleme" misyonuna uygun bir biçimde, çatışmaya ve soykırıma götürebilecek durumlara özgü göstergeleri saptayan bir karar almıştır. Komite'nin bu çalışmaları "soykırımı önleme" misyonundan "koruma sorumluluğu"na yönelen BM "yüksek politika"sı içinde gölgede kalsa da, soykırımın önlenmesinde çok daha etkili olabilecek bir yaklaşımı yansıtmaktadır.

Racial Discrimination, Early Warning and the Prevention of Genocide

The International Convention on the Elimination of All Forms of Racial Discrimination constitutes the most comprehensive normative basis of the prohibition of racial discrimination in international human rights law. The Committee on the Elimination of Racial Discrimination (CERD) which is the first "treatybased body" of the UN's human rights protection system is the monitoring organ of the implementation of the Convention. In addition to the examination of State reports, inter-state complaints and individual complaints, CERD elaborated an early-warning and urgent action procedure in 1993 to prevent serious violations of the Convention that may lead to ethnic conflict and violence. Also in 2005, following its declaration on the prevention of genocide, it adopted a decision on the indicators of patterns of systematic and massive racial discrimination. The work of the Committee deserves more support than UN's high politics which transforms the legitime aim of the prevention of genocide into a so-called "responsibility" to protect.
