Enerji Piyasası Düzenleme Kurulu’nın verdiği para cezalarının infazı öncesinde yapılan lehe yeni düzenlemenin nasıl uygulanacağı özellik arz eden bir durumdur. Lehe olan yeni düzenleme kurulun takdir yetkisini kullanmasını gerektirmeyecek şekilde belirli bir ceza miktarı öngörmüş ise, Kurulun yetkilendirdiği ilgili daire, lehe olan ceza miktarını belirleyip gelir idaresine göndermelidir. Bu surette gelir idaresi, kurulun önceki kararında yer alan ceza miktarını değil, lehe olan kanunda düzenlenen ceza miktarını tahsil etmelidir. Zira gelir idaresinin kendiliğinden, lehe olan kanunu uygulama yetkisi bulunmamaktadır. Eğer eski kanundaki ceza miktarı sabit ise ve yeni kanun bu miktarı düşürmüş veya tamamen ortadan kaldırmış ise, kurulun yeni bir karar almasına gerek bulunmamaktadır. Eğer eski kanunda ceza, alt ve üst sınırları olan basamaklı bir ceza olarak düzenlenmiş ve yeni kanunda cezanın alt ve üst sınırlarında, kişinin lehine olarak bir değişiklik yapılmışsa, bu durumda yeni bir kurul kararı alınması gerekir

Implementation of the new laws in favour entered into the effect before the execution of Ş nes given by the Energy Market Regulatory Authority is an important issue. If the new law in favor, stipulates a speciŞ c Ş ne which does not require the use of discretionary power of the Authority, the relevant department authorized by the board should determine the amount of the Ş ne and send it to revenue administration, since the revenue administration does not have power to apply new law ex ofŞ cio. In tis case, the revenue administration, shall charge the Ş ne set by the new law in favor, instead of the Ş ne determined by the previous law. If the Ş ne in the repealed law is a Ş xed one, and the new law has lessen or eliminated it, than the board doesn’t need to deliver a new decision. But if the repealed law determined a Ş ne with lower and upper limits and the new law lessened the amount of Ş ne in favour of individuals, then the board has to deliver a new decision
