GENETİK AYRIMCILIK YASAĞI

Genetik alanında özellikle 20. yüzyılın başından itibaren muazzam birgelişme görülmüştür. Hızı her geçen gün artan bu gelişmeler insanındoğasına ilişkin önemli soruların yanıtlanmasına katkı sağladığı gibi, dahauzun ve sağlıklı bir yaşam için de pek çok yeni olanak sunmaktadır. Öteyandan kişilerin gelecekteki sağlık durumlarına ilişkin öngörü sunan testler,bireyin bunlara dayalı olarak ayrımcılığa maruz kalma tehlikesiniberaberinde getirmektedir. Bu noktada bir insan hakkı olarak genetikayrımcılık yasağının değerlendirilmesi gereksinimi hissedilmektedir. Buçalışmada konuya ilişkin uluslararası hukuksal düzenlemeler ışığında genetikayrımcılık yasağının, kapsamı ve gerekliliği tartışılacaktır. Bu kapsamdaöncelikle genetiğin alanındaki araştırmaların sunduğu bilginin niteliğideğerlendirilecektir. Başta İnsan Hakları ve Biyotıp Sözleşmesi olmak üzeregenetik ayrımcılığı yasaklayan uluslararası sözleşmeler de incelemekapsamındadır. Ayrıca genetik ayrımcılığın söz konusu olabileceği alanlarınbelirlenmesi çalışmanın önemli bir parçasını oluşturur. Bu bilgiler vedeğerlendirmeler ışığında günümüzde ve gelecekte genetik ayrımcılıkyasağının insan hakları öğretisinde ve uygulamasındaki yerinin belirlenmesive çözüm yollarına yönelik bir bakış açısının geliştirilmesi hedeflenmektedir.

PROHIBITION OF GENETIC DISCRIMINATION

A significant progress has been made in genetic research in the 20 th century. These rapidly evolved developments have brought not just some key answers on the nature of human beings, but also new opportunities for a long and healthy life. On the other hand, predictive genetic tests pose a new threat to human rights and freedoms. Indeed, individuals have concerns to face with genetic discrimination. In this respect, there is a necessity to investigate prohibition of genetic discrimination as a human right. In this research, from the perspective international legal documents, foremost Convention on Human Rights and Biomedicine, the concept and necessity of prohibition of genetic discrimination will be analysed. To distinguish genetic information from the other types and to define the most problematic areas will be the core topics of the research. In the light of these information the main objective of the article is to ascertain the status of prohibition of genetic discrimination in theory and practice and to develop a fresh perspective to solve related problems.
