ÇİN MEDENÎ KANUNUNA GENEL BİR BAKIŞ
Çin Medenî Kanunu 28 Mayıs 2020 tarihindeki 13. Dönem Çin Ulusal
Halk Kongresinde kabul edilerek yasalaşmıştır ve 1 Ocak 2021 tarihinde
yürürlüğe girecektir. Çin Medenî Kanunu, 71 yıllık Çin Halk Cumhuriyeti
tarihinin ilk Medenî Kanunudur ve Çin’in reform ve açılım politikasının
sonucu olarak planlı ekonomiden pazar ekonomisine geçiş sürecinin bir
tamamlayıcısı olarak görülmelidir.
Bu çalışmada Çin Medenî Kanununun yasalaşmasına giden süreç,
Çin Medenî Kanununun sistematiği ve genel felsefesi ile Medenî Kanunu
oluşturan bölümlerden genel hükümler, aynî haklar, sözleşme hukuku,
kişilik hakları, evlilik ve aile hukuku, miras hukuku ve haksız fi il
sorumluluğu hakkında genel bilgiler verilerek Çin Medenî Kanunu genel
hatlarıyla tanıtılmaya çalışılmaktadır.
