The war on terror or the war on civil liberties: The state, society and the civil liberties since 2001

Özet: Demokrasi ve sivil özgürlükler ancak barış içinde ve şiddetten uzak toplumlarda gelişebileceği için terör, şiddet ve çatışma demokrasi ve sivil özgürlüklerin ihtiyaç duyduğu toplumsal ve siyasal ortama zarar verir. 2001 'de Amerika'da meydana gelen terör saldırıların dan bu yana başta Batılı demokratik ülkeler olmak üzere birçok devlet teröre karşı içte ve dışta ciddi bir savaşıma girmiştir. Terörizme karşı kesin bir başarının geçmişte ve yakın gelecekte olanaklı olup olmayacağı belirgin olmamakla birlikte, öte yândan, terör olayları ve terör karşıtı önlemler, liberal demokrasiler ve sivil özgürlükler alanında ciddi gerilemelere neden olmaktadır. Bu gerilemeler büyük ölçüde birbiriyle ilişkili üç olgu ile açıklanabilir; içte ve uluslararası politika alanlarında artan devletçi ve güç yanlısı yaklaşımlar, bu yaklaşımları destekleyici yeni anti-terör yasaları ve bunların etkisiyle manipüle edilmiş toplum ya da destekleyici toplumsal gruplar. Bu çerçevede, bu çalışma, demokrasi ve sivil özgürlüklerin son yıllarda'karşı karşıya olduğu asıl tehdidin sadece terör örgütleri ve teröristlerden değil, aynı zamanda devlet ve toplumun kendi içinden geldiğini, son yıllarda basın ve akademik özgürlüklere karşı gelişen tutumlar örneğinde, açıklamaya çalışmaktadır.

The war on terror or the war on civil liberties: The state, society and the civil liberties Since 2001

Democracies and civil liberties can only prosper within peaceful and nonviolent societies, and violent conflict and terror often harm the political and social atmosphere that they need to exist. Since the terror attacks on American soil in 2001 shocked the world, many states, especially Western democracies have started and fought an internal and external war on terror. It is unclear whether a definitive success against terrorism could have been achieved in the past, as much as it is the case fot the future. On the other hand, the events including terrorism and counter-terrorism measures have had tremendous setbacks on civil liberties worldwide. These setbacks can largely be explained within, and as the result of, three correlated phenomena; rising statist tendencies in domestic and international politics, anti-terror legislation that has been made to endorse the former and manipulated society or supportive groups. Based on selected cases of academia and the press, this paper, therefore, concludes that the threats and setbacks to civil liberties come not only from terrorist networks, but also from the state and society.
