Avrupa Birliği birincil hukukunda azınlıkların korunmasının hukuki dayanağı

Azınlıkların korunması konusunda Avrupa Birliği (AB) birincil hukukunda başlan¬gıçta söz konusu olan boşluğun içtihat hukuku ve günümüzde Lizbon Sözleşmesi ile doldurulmaya çalışıldığı görülmektedir. Azınlıkların korunmasına ilişkin AB mükte- sebatının şekillenmesinde AİHK'nın yanısıra Avrupa Konseyi Ulusal Azınlıklar Çerçeve sözleşmesi, üye devletlerin ortak anayasal gelenekleri ve AB Temel "Hakları Şartı rol oynamaktadır. Azınlıkların korunması, AB müktesebatında bir anayasa prensibi olarak kabul edildiği nispette AB kurumsal yapısında ihdas edilen tasarruf¬lara ve üye devletlerin AB müktesebatını icrasına esas olmakta ve AB 'ye aday dev¬letler bakımından da yerine getirilmesi gereken siyasi kriterler arasında değerlendi¬rilmektedir.

The legal basic of protection of minorities in the EU primary law

Abstract: In recent years, there have been increasing efforts to fill in the gap in the EU primary law on protection of minorities with case-law and the Lisbon Treaty. Besides the ECHR, Framework Convention for the Protection of National Minorities, constitutional traditions common to the member states and also the Charter of Fundamental Rights of the EU play an important role in shaping the EU acquis on the protection of minorities. The protection of minorities is considered as one of the political criteria that a candidate country has to accomplish and forms the basis of Community's acts and member states' application of the EU acquis as long as it is envisaged as a constitutional principle.
