Abd’ nin Irak İşgaline Uluslararası Hukuk Açısından Eleştirel Bir Bakış

Bu çalışma ABD’nin Irak’ı işgalinin uluslararası hukuk bakımından le- gal olup olmadığını incelemektedir. Bu amaçla önce uluslararası kamu hukukunun kaynakları ve temel karakteristikleri kısaca açıklanacaktır. Daha sonra, özellikle uluslararası ilişkilerdeki güç kullanma/tehdidi ve savaş açma yasağının uluslararası hukuktaki gelişimi konusu ele alına- caktır. Günümüz Birleşmiş Milletler uluslararası hukuk sistemi sadece işgalci bir güce karşı meşru müdafaa ile uluslararası barış ve güvenliği korumak için Birleşmiş Milletler Güvenlik Konseyi’nin karar vermesi durumları için geçerli olmak üzere güç kullanımına izin vermektedir. Bu bakış açısını Irak’ın işgalini meşru göstermek için ABD tarafından ifade edilen gerekçelere uyguladığımızda, mahut gerekçelerin kesinlikle uluslararası hukuka uygun olmadığı sonucu tartışılacaktır.

A Critical look at the Us Invasion of Iraq from the perspective of ınternational law

This study concerns itself with whether or not the invasion of Iraq by the U.S. was legal in terms of international public law. For that purpose, first the basics of international public law, like the sources and fundamental characteristics of it, will be shortly explained. Then, in particular, it will be discussed on the development of the prohibition in international law for waging war and the threat/use of force in international relations. The current system of international law of the United Nations allows use of force only in an act of legitimate defense against an occupying power and with an authorization by the United Nations Security Council to protect international peace and security. We apply for this view to the reasons for war mentioned by the U.S. as justifications for the invasion of Iraq and concludethat they are incompatible with international law.
