Kadın haklarının uluslararası hukuki çerçevesi

Bu makale yirminci yüzyılın ortalarından bu yana gelişmekte olan uluslararası insan hakları hukukunun, 1980lerde kadına yönelik şiddet odaklı yoğunlaşan kadın hareketinin uğraşları sonucu uğradığı dönüşümünü ele almaktadır. Bu bağlamda, özellikle uluslararası hukuktaki 'özen yükümlülüğü ' ilkesinin daha kapsayıcı bir anlayışla yeniden tanımlanması sonucu oluşan kadının insan haklarına dair uluslararası hukuki çerçeve, bunun ulusal iç hukuka yansımaları, ve kadına yönelik şiddet ile mücadeleyi temellendiren kavramsal yaklaşımları, karşılaşılan engel ve sorunları analiz edilmektedir. Küresel bir bakış açısına sahip olan makalede Türkiye'ye ilişkin değerlendirme ve örneklere de yer verilmektedir.

International framework for women's rights

This article hightlights the transformation of the mainstream international human rights law, which has been evolving since the middle of the twentieth century. This transformation is largely a consequence of the efforts of the international women's movement, particularly since the 1980's, that gave visibility to violence against women as a public policy and human rights concern. Within this context, the emergence of a women's rights regime with the application of a broadened understanding of the 'due diligence' principle, its domestic application and the conceptual underpinnings of the struggle to combat violence against women as well as persisting obstacles and challenges are analyzed. While the article adopts a global approach, reference to the case of Turkey is made where relevant.
