1998 Suriye’ye Türk Kuvvet Kullanma Tehdidinin Hukukîliği

Ülkesindeki iç savaşın başlangıcından bu yana Suriye rejimi, Türkiye’yi asileri desteklemekle suçluyor. Yaklaşık 20 sene önce, iki komşu devletin hukukî pozisyonu tümüyle farklıydı. Öyle ki, 1998’de Türkiye, ayrılıkçı Kürt silahlı grup PKK’nın lideri Abdullah Öcalan’ı ülkesinde barındırmasından caydırmak için Suriye’yi kuvvet kullanmakla tehdit etti. Bu makale Türk eyleminin uluslararası hukukîliğini araştıracaktır.

The Legality of the 1998 Turkish Threat of Force against Syria

Since the beginning of the civil war in its country, the Syrian regime has been accusing Turkey of supporting the rebels. Almost 20 years ago, the legal positions of these two neighbouring countries were sharply different; such that in 1998, Turkey threatened to use force against Syria to deter this country from harbouring Abdullah Ocalan, the leader of the Kurdish separatist armed group, the PKK. This article will examine the international legality of the Turkish action.
