Sanatçıların çalışma hayatında yer almaya başlaması, onların korunma- sı gerekliliğini de beraberinde getirmiştir. Sanatçıların çalışma hayatına ilişkin koşullar değerlendirildiğinde, çoğunlukla esnek çalışma biçiminin benimsendiği görülmektedir. Öte yandan sanatçıların büyük çoğunluğu yayıncılara veya ya- pımcılara ekonomik ve kişisel yönden bağımlı olarak çalışmaktadır. Sektörde, ağır çalışma koşulları, atipik ve düzensiz çalışma biçimleri dikkat çekmekte ve uzun çalışma saatleri, önceden öngörülemeyen gelir düzeyleri ile sosyal güven- cesizlik gibi olumsuzluklar yaşanmaktadır. Anayasamıza göre Devlet, sanat faaliyetlerini ve sanatçıyı korur. Sanat eserlerinin ve sanatçının korunması, değerlendirilmesi, desteklenmesi ve sanat sevgisinin yayılması için gereken tedbirleri alır (m.64). Bunun gibi, Anayasa’nın 60. maddesinde herkesin sosyal güvenlik hakkına sahip olduğu belirtilmiştir. Sanatçıların sosyal haklarının ve sosyal güvenliklerinin korunmasına ilişkin uluslararası düzenlemeler ve Ana- yasamızdaki genel kurallar, zamanla Türk hukukunu ve doktrini de etkilemiş ve Türk sosyal güvenlik mevzuatında konu hakkında bazı düzenlemeler yer almıştır. Bu çalışma, sanatçıların sosyal güvenliğini 5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu ve ilgili mevzuat açısından değerlendirmeyi amaçlamaktadır.

After the artists took place as workers, the necessity of protecting the artists in the worklife has arised. When the conditions of the artists’ working life was evaluated, it was seen that it also adopts the flexible working types. On the other hand, the majority of artists are economically and personal dependent on publishers or producers. The sector draw attention with the heavy working conditions, atypical and irregular working patterns; it contains in itself many problems such as long working hours, unpredictable income levels and social insecurity. Constitution of the Republic of Turkey states that the State shall protect artistic activities and artists and the necessary measures to protect, promote and support artists, and encourage the spread of appreciation for the arts (art.64). Also, according to article 60 of Turkish Constitution, everyone has the right to social security. The international regulations regarding the protection of social rights of artists and constitutional principles have also had an impact on Turkish law and doctrine. Some principles have already been adopted by the Turkish social security legislation. This study aims to analyze the social security of artists in terms of Social Security And Universal Health Insurance Law No: 5510, the further related legislation in Turkey
