Asayiş ve güvenlik görevi yerine getirirken, bir saldırı sonucu ölen ya da yaralanan güvenlik görevlisinin Milli Savunma Bakanlığı aleyhine açacağı tazminat davası çeşitli sorunları içermektedir. Sosyal Güvenlik Kurumu tarafından yapılan yardımların rücu edilmesi halinde, aynı davalarda saldırıya uğrayan asker daha az tazminat alabilmektedir. Bu durum adalet duygusunu sarsmaktadır. Sosyal Güvenlik Kurumunun rücu hakkı ve 2330 sayılı Kanun kapsamında yapılan yardımlara ilişkin tazminat sorumluluğunun esaslarının yeniden değerlendirilmesi gerekmektedir
