Azınlık haklarında hareketle ulusal azınlıklar ve ulus-devlet ikilemi

Bu çalışmada, ulusal azınlıklara tanınan haklar Ronald Dworkin 'in haklar tezinden hareketle insan onuru ve eşitlik düşüncesi üzerine temellendirilmektedir. Buna göre, kişiye diğerlerine nazaran daha az insanmış ya da ilgi ve alakaya daha az layıkmış gibi davranma sonucunu doğuran bir yaklaşım hukuk idesi île bağdaşmamaktadır. Demokrasiyi vatandaşlar için "süper toplum " yaratan ulus-devlet düşüncesi üzerine inşa eden klasik liberal demokrasi anlayışı ise, vatandaşların ulus-devletin bir parçası olmanın yanı sıra aidiyet, kimlik, anlam ve amaç duygusu sağlayan kültürel, dilsel ya da etnik bir gruba ait olduğunu ihmal etmiş ve nihayetinde çok kültürlülük argümanlarıyla hesaplaşmak durumunda kalmıştır. Çalışmada, ulusal azınlıklar ve ulus-devlet ikileminin hak-temelli bir anlayışla liberal demokrasinin azınlık-çoğunluk ilişkisi temelinde yeniden organize olması ve özellikle derin biçimde bölünmüş toplumlarda ortaklıkçı düzenlemelerle güç paylaşımına yer vermesi ile çözülebileceği ortaya konmaktadır.

The dilemma of national minorities and nation-state

In this paper, following Ronald Dworkin's theory of rights, it is assumed that the basis of minority rights is equality and human dignity. Our principal argument is that any approach treating man as less than a man or as less worthy cannot be consistent with the idea of law. Nevertheless, classical liberal democratic theory which bases democracy on the idea of nation-state that creates a "super society" for its citizens, neglects the fact that every citizen also belongs to a particular community. For this reason, the nation-state has to confront with the attacks of multiculturalism. In this paper, it is argued that the paradox of national minorities and nation-state can be solved with a right-based approach according to which liberal democracy should be reorganized on the basis of minority-majority relations and, especially in deeply-divided societies, through consociational arrangements that would enable power-sharing.
