Yeni Anayasacılık ve Dünya Yüzündeki Eşitsizliklerin Anayasallaştırılması

Dünyada giderek artan eşitsizlikler, güven ortaminin kalmayişi, sosyal çarpikliklar siyasetin gelişmekte olan yeni dünya düzeni doğrultusunda yeniden tanimlanmasini gerektirmektedir. Bu yeniden tanimlamanin bir bölümü yeni bir yapisallaşmanin gelişimini ihtiva etmektedir. Yeni anayasacilik da yeni dünya düzeninin oluşturulmasinin ve sürdürülmesinin önemli bir parçasidir. Yeni anayasacilik politik ekonomi üzerinde temel unsurlarin demokratik kontrolünü nerdeyse imkansiz hale getirmekte ve bu duruma bir kilit vurarak gelecek yönetimlerin bu kilidi açabilmesini engellemektedir. Gill'in deyimiyle bu yeni anayasacilik yoluyla tepeden inme küreselleşmedir. Bu küreselleştirmeye ise tabandan milliyetçiler ve muhafazakarlar gibi çeşitli kesimlerden tepki gelmekte ve giderek yoğunlaşan karşi çikişlar olmaktadir. Bu makalede insanlar arasindaki eşitsizliklerin-bilhassa ekonomik eşitsizliklerin - yeni anayasacilik yoluyla nasil anayasal hale getirildiği ve olasi muhalefetlerin önüne geçmeyi nasil başarabileceği incelenmektedir.

New Constitutionalism and Constitutionalizing Inequalities on the World

Inequalities which are increasing day by day, social dislocations and human insecurity have coincied with a redefinition of the political in the emerging world order. Part of this redefinition involves the emergence of new constitutionalism. New Constitutionalism limits democratic control over central elements of economic policy and regulation by locking in future governments to liberal frameworks of accumulation premised on freedom of enterprise. With Gill's words this is globalization through new constitutionalism. And against this globalization new movements as nationalists, conservaties arise and these movements day to day are increasing.In this article how inequlaties among humans are being constitunal through new constitutionalism and how can be successful against potential oppositional movements is analysed.
