Deniz ticareti Hukukunda hazırlık ihbarı

Hazırlık ihbarı, geminin, yükleme veya boşaltma yerine vardığının taşı-yan tarafından taşıtanlara bildirilmesidir. Hazırlık ihbarı, gemin vardığı ve yükleme/boşaltmaya (yüke, denize elverişlilik gibi) tüm açılardan hazır ol-duğu anlamına gelir. Hazırlık ihbarı, çarter partilerde aksine bir hüküm yoksa, sözlü olarak verilir. Öte yandan, hazırlık ihbarı starya süresinin baş-laması için gereklidir. Hazırlık ihbarı verilebilmesi için geminin çarter par-tide belirlenen rıhtıma yanaşmış olması ve bazı formalitelerin yerine getiril-miş olması gerekir. Bununla birlikte, çarter partilere konan klozlarla bunun aksine düzenleme yapılabilir. Bu klozlar arasında wipon (gemi limanda ol-sun olması), wibon (gemi rıhtıma yanaşsın yanaşması), time lost (rıhtım beklenirken kaybolan zamanın staryadan sayılması) veya serbest pratika alınsın alınmasın gibi klozlar yer almaktadır. Bu klozlar gereği, geçerli bir hazırlık ihbarında bulunabilmek için geminin rıhtıma yanaşması veya bazı formalitelerin yerine getirilmesi aranmamıştır

Notice of readiness in the maritime trade law

Once the vessel has arrived at the place for loading and is ready to load, notice of readiness can and must be given to the charterer This notice informs the charterer that the ship has arrived at the port and is ready in all respects to load or discharge. Unless the charter party provides otherwise, notice of readiness may be oral. The notice of readiness is required for the initiation of laytime. For the notice to be effective, the vessel must actually be prepared to receive or to discharge cargo. The charter party may contain a wibon (whether in berth or not) or time lost (time lost in waiting for berth to count as loading/discharging time) or whether free partique or not claus İf the loading/discharging berth is not available on the vessel’s arrival at or off the port of loading/discharging, the vessel shal be entitled to give notice of readiness on arrival there.
