Avrupa Birliği Hukuku Çerçevesinde Avrupa Birliği’ndeki Türk Vatandaşları ve Aile Birleşimi

Aile birleşimi, Avrupa Birliği (“AB”) hukuku söz konusu olduğunda, özellikle de Türk vatandaşları ile ilgili olarak, aslen iki sebeple berraklaştırılmayı bekleyen bir konu hâlini almıştır. Bir taraftan, AB hukuku, 10 Temmuz 2014 tarihli Doğan kararının gösterdiği üzere, diğerlerinin yanında, AB ile Türkiye arasındaki ortaklık hukukundaki standstill hükümleri üzerinden güncel gelişmeler içindedir. Diğer taraftan, bu tür gelişmeler; AB, Türkiye ve Türk vatandaşları yönünden kayda değer potansiyel niceliksel ve niteliksel etkiye sahiptir; zira hem Türk vatandaşları, AB içinde yerleşik üçüncü ülke vatandaşları arasından en kalabalık gruptur hem de aile birleşimi, AB’de verilen yeni ikamet izinlerinin en önde gelen sebebidir. Bu çalışma, AB hukuku çerçevesinde AB’deki Türk vatandaşlarının aile birleşimini berraklaştırmayı amaçlamakta ve konuyu AB’nin üçüncü ülke vatandaşları ile ilgili mevzuatı, AB ile Türkiye ortaklık hukuku ve AB insan hakları rejimi bağlamında ele alarak, netleştirmektedir

When European Union (“EU”) law is at stake and especially with regard to Turkish citizens, family reunification has become a subject which waits to be clarified mainly for two reasons. On the one hand, EU law has been in actual developments inter alia via the standstill provisions in the association law between EU and Turkey which is shown by the Dogan decision of 10 July 2014. On the other hand, these kind of developments have significant potential quantitative and qualitative effects in relation to EU, Turkey and Turkish citizens; not only because the Turkish citizens are the most populated group among the third country nationals living in the EU; but also because family reunification is the primary reason for granting new residence permits. This paper aims to clarify the family reunification of Turkish citizens in the EU in the framework of EU law and deal with and elucidate on this matter in the context of the legislation of the EU relating to the third country nationals, association law between EU and Turkey and human rights regime of the EU
