Uluslararası İnsancıl Hukuk ve Terörizme Karşı Nükleer Silahların Kullanımı

Günümüzde uluslararası terörizm, ortaya çıkardığı etkiler ile uluslararası barış ve güvenliği tehdit eden unsurların başını çeker duruma gelmiştir. Söz konusu durumun uluslararası hukuk yapısını etkilemesi kaçınılmaz olmuştur. Gerek terörizmin kendisi gerek terörizme karşı devletlerin başvurduğu operasyonlar, uluslararası hukukun mevcut kurallarını tekrar tartışmaya açmıştır. Terörizme karşı mücadelede kuvvet kullanılarak, uluslararası İnsancıl Hukuk kurallarının bu tür eylemlere uygulanabilirliği tartışılabilir hale gelmiştir.Çalışmamızın ilk bölümünde terörle mücadelede İnsancıl Hukukun uygulanması, İnsancıl Hukukun uygulama kapsamı ve terörizmle mücadele konusundaki uluslararası andlaşmalar, İnsancıl Hukukun terörist eylemlerine uygulanması ve BM Güvenlik Konseyi’nin konuya ilişkin kararları ele alınacaktır. Çalışamanın temelini oluşturan ikinci bölümde ise, terörle mücadele sırasında nükleer silah kullanımının gayri meşruluğu hususu değerlendirilecektir

INTERNATIONAL HUMANITARIAN LAW AND USE OF NUCLEAR WEAPONS AGAINST TERRORISM

Nowadays international terrorism has come to the forefront of threat to peace and security by the effects that it has created. This status has also infl uenced the structure of international law. Terrorism by itself or the operations done against terrorism by the states, have opened way for disputes over the status quo of international law. Dispute have arisen whether international humanitarian law principles are applicable to the use of force in the fi ght against terrorism.In the fi rst part of the present study, the application of humanitarian law in the fi ght against terrorism, the scope of humanitarian law, international conventions regarding fi ght against terrorism, the application of humanitarian law to terrorist operations and UN Security Council decisions regarding the discussions will be overviewed. In the second and most prominent part of the study the illegality of the use of nuclear weapons in the fi ght against terrorism will be investigated
