Adaleti Sağlamak Değil, Hakikati İnşa Etmek: Engizisyon Yargılama Usulü

Engizisyon usulü, yargılama tekniklerinde önemli bir tarihsel dönüşümü imlemekte, adaleti sağlamayı değil, önceden inşa edilmiş bir hakikati suçluya itiraf ettirmeye odaklanmaktadır. Bu tekniklerin kullanımı, Kilise doktrinine göre sapkın (heretic) ilan edilmiş inanç gruplarına karşı uygulanmaya başlamış ve asıl olarak politik bir hakikati onlar aracılığı ile inşa etmeye yönelmiştir. Bu yargılama usulü Avrupa tarihinde cadı avı olarak bilinen büyük oranda kadınlara karşı girişilen suçlarda da etkin olarak kullanılmıştır. Türkiye’nin son on yılında görülen büyük siyasi davaların eleştirmenlerinin çok sık atıf yaptığı bu usulün günümüze kalmış izleri bulunmaktadır.

NOT TO SECURE THE JUSTICE, TO CONSTRUCT THE TRUTH: INQUISION TRIAL PROCEDURE

Inquisition procedure refers to a crucial historical transformation in the context of trial procedures. It focuses not to secure justice but to have confession from the suspect for constructing the truth. The use of these techniques had been initiated against people or movements that were stigmatized as heretics by the Church and the real aim of the Church was to construct a political truth through these herecy claims. The Inquisition procedures was used in the course of the witch hunt period of European History as well. The traces of these procedures have been indicated by the critics of the last serious political trials in Turkey.
