Uluslararası Andlaşmalarda Ardıllık ve İnsan Hakları Sözleşmeleri

Yakın yıllarda, çok uluslu bir yapıya sahip olan Sovyet Sosyalist Bloku devletlerinin parçalanması, çok sayıda bağımsız yeni devletin ortaya çıkmasına yol açmış ve bu gelişme, devletlerin anlaşmalara ardıllığı sorusunu yeniden tartışma konusu yapmıştır. Bu tartışmalar özellikle insan hakları sözleşmelerine ardıllık bakımından özel bir düzenleme gerekip gerekmediği noktasında yoğunlaşmıştır. Özellikle de insan hakları sözleşmelerine otomatik ardıllık tezi, öğretide savunulduğu gibi uluslararası uygulamada da destek görmektedir. Bu çalışmanın amacı, bu tür sözleşmelerin ardıllık bakımından ne ölçüde farklı bir çözüm gerektirebileceğini incelemektir.

The Principle of Succession of Succession in International Treaties and Conventions on Human Rights

In recent years, the dissolution of the Soviet Socialist block which had a multinational structure has led to coming out so many newly independent states and also, such a situation has brought the debate ones more on succession problem to the agreements for the states. The debate has concentrated especially on the necessity for a new arrangement about the succession for the international treaties and conventions on human rights. Automatic succession thesis especially to the Conventions on Human Rights is supported by the international practice as well as it is defended in doctrine. The aim of the study is to discuss such conventions might necessitate a different solution to the succession problem.
