MÜŞTEREK AVARYANIN UNSURLARI HAKKINDA GENEL BİR İNCELEME

Müşterek avarya, deniz sigortasının henüz var olmadığı antik çağlardan günümüze kadar etkinliğini devam ettiren ve deniz yolu taşımacılığındaki yüksek riski belli koşullar çerçevesinde hakkaniyet uyarınca dağıtan en eski ve köklü deniz ticareti kurumlarından birisidir. İşbu çalışmada müşterek avaryanın olmazsa olmaz unsurları hedef alınmış ve bu bağlamda öncelikle hukuksal açıdan tarihsel gelişime daha sonra da günümüzdeki geçerli hukuki yapıya bakılmıştır.

General average,which has been in existence since the ancient times, is one of the oldest and most fundamental institutions of maritime commerce, whereby the high risk of sea transport has been spread equitably under certain conditions. This paper, is on the essential elements of general average; its historical development and its current legal structure.
