HUKUK DEVLETİ VE GÜÇLER AYRILIĞI PRENSİBİ BAĞLAMINDA AMERİKA BİRLEŞİK DEVLETLERİ YARGI SİSTEMİNDE FEDERAL YÜKSEK MAHKEMENİN ROLÜ

Türkiye'den bir yargıç olarak, Washington DC'de bulunan Amerika Birleşik Devletleri Federal Yüksek Mahkemesine 25 Mart 2013 tarihinde yapılan ziyarete ve Mahkeme Başkanı Yüksek Yargıç John Glover Roberts'le gerçekleştirilen söyleşiye davet edilmek gerçekten büyük bir onurdu.2 Bu heyecan bizi Anayasa yapım sürecinde bulunan ve yargının tarihinde olmadığı kadar ülke gündeminde tartışıldığı bir dönemde, Türk meslektaşlarımızla bu ayrıcalıklı deneyimi paylaşma düşüncesine sevk etti. Tarafımızdan ve bizimle birlikte programa katılan bazı hukukçuların da yönelttiği sorular üzerine Başkan Roberts'in verdiği ufuk açıcı cevaplardan not edebildiklerimizi serbest söyleşi formatında kalıcı hale getirmek istedik. Metinde yer alan notlar, söyleşi sırasında Başkan Roberts'in verdiği yanıtlarda ifade ettiği hususları bilimsel bir hassasiyetle detayları kaynaklarından bulunarak bazı şerhlerle genişletilmiştir. Belirtmek gerekir ki, söyleşide yöneltilen sorulara karşılık Başkan Roberts'in verdiği cevapların büyük bir kısmını not almak da mümkün olmadı. Bu çalışmaya Yüksek Mahkeme ziyaretinden ve başkanı ile yaptığımız söyleşiden esinlenerek başlanıldıysa da; tam olarak hafızada tutmak mümkün olmadığından Saygıdeğer Başkan Roberts'in sözleri, doğrudan atıflar olmaksızın aktarıldı. Bu nedenle, bazı mukayeseler içeren bu çalışmada Başkan Roberts'ın tarihten örneklerle dolu öğretici demeçleri ışığında Türkiye'deki güncel yargısal sorunların ele alındığı söylenebilir.

(THE FUNCTION OF THE SUPREME COURT OF THE UNITED STATES UNDER THE PRINCIPLES OF THE RULE OF LAW, AND THE SEPARATION OF POWERS)

As a Turkish Judge, it was a real honor to be invited to the Supreme Court of the United States to observe a conversation with Chief Justice John Glover Roberts, in Washington, DC on March 25, 2013.3 This enthusiasm has motivated me to share this exclusive experience with our Turkish colleagues during a period when new Constitutional Code is being drafted and when the judiciary has been subject to more debates than ever in its history. I wanted to take notes of the eye-opening answers Chief Justice Roberts provided to the questions asked by the jurists who attended the program, including me, to preserve it for the posterity. The notes in the text have been extended with annotations to expand the issues pointed out in the answers given by Chief Justice during this conversation, the details of which are found within the sources. It should be mentioned that it was not possible to take notes with regard to some of the answers given by Chief Justice Roberts to the questions. Although this paper was originated from the visit to the Supreme Court and talk with chief justice Roberts, his remarks were incorporated into this article without direct quotations since it is impossible to remember what the Honorable Justice exactly said. Thus, it may be said that, this article which includes some analogies, is written to cover current judicial problems in Turkey in light of Chief Justice Robert's educational remarks with many historical examples.
