Avoidance under the cisg and termination under english law in documentary sales

Milletlerarası Mal Satımına İlişkin Sözleşmeler Hakkında Birleşmiş Milletler Antlaşması'nda ("CISG") değişik tipteki satım sözleşmelerine ilişkin hükümlerin yer almaması, CISG'ın kapsam ve uygulama alanını ilgilendiren önemli sorunlarından biridir. Aynı sorun İngiliz hukukunda gözlenmemektedir. Bu makalede, CISG'da düzenlenen satım sözleşmesinin sona erdirilmesi beyanı (iptali) ile İngiliz hukukunda satım sözleşmesinden dönme hakkının kullanılması hukuki imkânları, emtia borsalarında menkul kıymet alım-satımı bakımından incelenmiştir.

Belgeye dayalı satımlarda cisg'a göre sözleşmenin sona erdirilmesi ile ingiliz hukukunda sözleşmenin feshi

The absence of special provisions regulating different types of sale contracts, is one of the most remarkable problems of the United Nations Convention on Contracts for the International Sale of Goods ("CISG") related to Us scope and application, a problem which is not observed in English law. In this essay, avoidance of contract under the CISG and right of termination under English law as remedies in case of documentary sales of commodities are considered.
