ABD haksız rekabet yasası (Unfair competition act) çerçevesinde fikri mülkiyet haklarına uyumun bilişim teknolojisi sektörü özelinde sürdürülebilir ekonomik kalkınmaya etkisi ve sağlayacağı avantajlar

Amerika Birleşik Devletlerinde yürürlüğe giren “Haksız Rekabet Yasası (Unfair Competition Act)”’nda yer alan hükümler ışığında, fikri mülkiyet haklarına uyumun sürdürülebilir ekonomik kalkınmaya etkisi ve sağlayacağı avantajların farklı segmentlerde ele alındığı bu makale; dona- nım ve yazılım ürünleri bazında Bilişim Teknolojileri (BT) sektörünün gerek lokal gerek global ölçekte sağlıklı büyüyebilmesi, adil rekabet orta- mının yaratılabilmesi, ulusal ve uluslararası ekonomiye pozitif katkının artırılmasının temel kriterlerinden biri olarak fikri mülkiyet haklarının hu- kuka uygun kullanımı gerekliliğinin altını önemle çizmektedir.

The advantages and effects of the compliance of intellectual property rights specifi to it sector on sustainable economic development within the scope of unfair competition act of the Usa

Within this Article, in the light of the Unfair Competetion Act (UCA) which came into force in the United States, we took into consideration of the effects of the compliance to the Intellectual Property (IP) rights on sustainable economic development and tackle it’s advantages in different segments. We underline legal use of IP rights as a key criteria in terms of a healthy growth of IT sector on the basis of software and hardware prod- ucts both local and global scale, in order to create a fair competition envi- ronment and to increase positive contribution to the national and interna- tional economy.
