Self-Determinasyon Hakkı ve Kosova

Self-determinasyon hakkı diğer bir tabirle kendi mukadderatını tayin hakkı (SDR) uluslararası hukukta dinamitlerle yüklü bir kavram olarak nitelendirilmektedir. SDR Birinci Dünya Savaşı’nın nedenini oluşturduğu gibi, günümüzde de bağımsızlık hareketlerinin, diğer taraftan da mevcut devletlerdeki farklı etnik grupların taleplerinin dayanağını oluşturmaktadır. Makalede ağırlıklı olarak uluslararası hukukun temel ilkesi olan “devletlerin toprak bütünlüğü” ilkesi ile SDR’nin ne şekilde bağdaştırıldığı Kosova örneğinde ele alınarak değerlendirilmiştir.

Kosovo and the Self Determination Right

Abstract: The right, of self determination (SDR) is an explosive concept in international law. As SDR was the motivating factor for the WWI; in the contemporary time, it forms the ' basis for independence movements and on the other hand, the basis for the demands of different ethnic groups in modern states. n this article, mainly, reconciliation states' territorial integrity, one of the fundamental principles of international law, and the SDR is going to be evaluated.
