KORUMA SORUMLULUĞU KAVRAMI VE LİBYA OPERASYONU

Bu çalışmanın temel amacı, tartışmalı insancıl müdahale kavramı ye- rine geliştirilmeye çalışılan koruma sorumluluğ u kavramının tarihsel gelişimi, içeriğ i ve eleştirilerini değerlendirmektir. 2001 yılında Müda- hale ve Devlet Egemenliğ i Komisyonunun hazırlamış olduğ u bir rap orla kapsamlı bir şekilde değerlendirilen kavram, Birleşmiş Milletler (BM) nezdinde kabul görerek Soğ uk Savaş sonrası dönemde sıklıkla yaşanan iç çatışmalara karşı uluslararası toplumun bakış açısını şekillendirme hususunda önemli bir g irişim olarak görülmektedir. Kavramın devlet p olitikalarını biçimlendiren bir uluslararası norm haline gelebilme- si, kavramla ilişkili uyg ulamaların başarısı ile yakından ilg ilidir. Bu kapsamda çalışmanın örnek olayı olarak, 2011 yılında BM Güvenlik Konseyinin 1973 sayılı kararına dayanılarak NATO taraf ından ger- çekleştirilmiş olunan Libya Op erasyonu (Şaf ak Yolculuğ u Op erasyonu) ele alınmaktadır. Op erasyona ilişkin Güvenlik Konseyi kararlarının üç temel unsura dayandırıldığ ı görülmektedir. Bunlar; koruma sorumlu- luğ u kavramı, BM Şartının VII. Bölümü ve bölgesel organizasyonların op erasyona yönelik tavırlarıdır. Bu unsurlar birlikte değerlendirildiğ in- de, op erasyonun uluslararası hukuk açısından yasal olduğ u sonucuna ulaşmak mümkündür. Ancak op erasyonun olması gerekenden daha şiddetli bir şekilde cerayan etmiş olması, op erasyonu gerçekleştiren ana aktörlerin op erasyonun amacını aşan davranışları ve koruma sorumlu- luğ u kavramının kendi içerisindeki mevcut çelişkileri op erasyonun bu yasallığ ına gölge düşürmüştür. Bu sonucu ortaya koymak için çalışma- da öncelikle koruma sorumluluğ u kavramına ve bu kavramın gelişim sürecine ışık tutulacak, ardından Libya Op erasyonuna g iden sürece kısa bir şekilde değ inildikten sonra op erasyonun önünü açan Güvenlik Konseyi kararları incelenecektir.

THE CON CEPT OF THE RESP ONSIBILI TY TO PROTECT AND THE LIBYA OPERATION

The main goal of this study is to evaluate the historical evolution, con- tent, and critiques of the concep t of the resp onsibility to p rotect (R2P), which has been develop ed in place of the controversial concep t of hu- manitarian intervention. The concep t, which was f irst comp rehensively evaluated in a rep ort by the International Commission on Intervention and State Sovereignty in 2001, is seen as an imp ortant attemp t to shap e the stance of the international community over the internal conf licts that have f requently erup ted af ter the Cold War. The evolution of the concep t into an international norm that g uides state p olicies is closely related to the success of op erations based on the concep t. In this context, the Libya Op eration (Op eration Odyssey Dawn), which was implemented by NATO as a result of the United Nations Security Council Resolution 1973, constitutes the case study of this article. The UNSC resolutions related to the op eration rely up on three key elements: the concep t of the Resp onsibility to Protect, Chap ter VII of the United Nations Charter, and the resp onses of reg ional organizations towards the op eration. It is p ossible to conclude that the op eration is legal by considering these f ac- tors. Yet, the use of excessive p ower during the op eration, the key actors behaviors that went beyond the aim of the op eration, and the p resent dilemmas of the resp onsibility to p rotect overshadow the legality of the op eration. In order to pave the way f or this conclusion, the concep t of the Resp onsibility to Protect will be examined f irst, then the p rocess which led to the op eration will be summarized, and f inally the Security Coun- cil Resolutions that allowed the op eration will be analyzed.
