Damgalama Yaklaşımı ve Onarıcı Adalet Bağlamında Denetimli Serbestlik

Suça neden olan etkenleri anlamak ve başarılı suç kontrolünü sağlamak oldukça güçtür. Suçun dinamik ve karmaşık yapısı nedeniyle suçu önleme çözümüne yönelik birçok kriminolojik ve sosyolojik yaklaşım geliştirilmiştir. Bu yaklaşımlardan damgalama kuramı, resmi yaptırımların gelecekteki suçlu davranışları caydırmak yerine damgalamaya neden olarak güçlendirdiğini iddia etmekte ve suçla mücadelede onarıcı adalet yaklaşımını önermektedir. Özellikle damgalama teorisyenlerinden John Braithwaite yeniden bütünleştirici utandırma yaklaşımını ortaya atmış ve bu teori onarıcı adalet anlayışının gelişiminde oldukça etkili olmuştur. Bu makalede damgalama teorisyenlerinin suçluluğu veya en azından damgalamanın olumsuz etkilerini azaltmada etkili olabileceğini önerdiği bazı yaklaşımlar ve uygulamalar ele alınmıştır. Bu çalışmada onarıcı adalet bağlamında Braithwaite’in suçla mücadelede utandırmanın gücünden olumlu yönde faydalanılabileceğini öne sürdüğü yeniden bütünleştirici utandırma yaklaşımı çerçevesinde denetimli serbestliğin damgalanmayı önleme, utandırma gücü ve topluma yeniden entegre etme potansiyelini tartışmak amaçlanmıştır. Nihayetinde denetimli serbestlik uygulamalarının, topluma verilen zararı telafi etme fırsatı vermesinin onarıcı adaletin hedeflerine uygun göründüğü ve suç işleyene karşı gösterilen olumsuz tutumları önleme konusunda önemli potansiyele sahip olduğu sonucuna varılmıştır.

Probation in the Context of Stigmatization Approach and Restorative Justice

It is very difficult to understand the factors that cause crime and to control successful crime. Due to the dynamic and complex structure of the crime, many criminological and sociological approaches have been developed for the solution of crime. From these approaches, the theory of stigmatization claims that official sanctions strengthen as a cause of stigmatization rather than deterrence of future guilty behaviors and proposes a restrictive justice approach in the fight against crime. In particular, John Braithwaite, one of the theorists of stamping, put forward the re -integrative embarrassment approach, and this theory was very effective in the development of repairing justice. In this article, some approaches and practices, which stigmatization theorists propose that the theorists propose that they may be effective in reducing the negative effects of stigmatization or at least. In this study, it is aimed to discuss the potential of preventing stigmatization, embarrassment and re -integration into society within the framework of the re -integration approach that Braithwaite claims that embarrassment can be used positively in the fight against crime in the context of repairing justice. Ultimately, it was concluded that the application of probation practices to compensate for the damage given to the society seems to be in accordance with the objectives of restorative justice and had significant potential to prevent the negative attitudes against the crime.
