İmtiyaz ve İstisna: Locke ve Schmitt’te Yasa, Egemen ve Olağanüstü Hal

Egemeni, “olağanüstü hale karar veren”  olarak tanımlayan Schmitt,  hukuk düzenini savunan liberalizmin siyasal olanın doğasını kavrayamayacağını  ve siyasalın doğasını açığa vuran olağanüstü durumla baş edemeyeceğini iddia eder. Bu minvalde Schmitt, Locke’u da devleti bir makine gibi tasarladığını düşündüğü liberal legalist geleneğe yerleştirir ve eleştirir.  Oysa Locke kolaylıkla Schmitt’in legalist liberal geleneğe dair genellemesine uymaz.  Çünkü istisna ile baş etmek söz konusu olduğunda o, yönetimi sanıldığı ölçüde yasayla sınırlanmaz; yönetimi imtiyaz gücüyle tahkim eder.  Bazen yasaya aykırı eylemde bulunmayı dahi içerebilecek olan imtiyaz yetkisi olağanüstü durumlarla baş etmek  için  yönetime  tanınmış bir takdir yetkisidir. Bu yetki halkın iyiliğe kullanılmak zorundadır. Schmitt, Locke’un bu imtiyaz kuramını büyük ölçüde görmezden gelir. İmtiyazla güçlendirilmesine karşın Lockecu yönetim asla Schmittçi anlamda kadir-i mutlak bir egemen olamaz; Tanrı’yı ikame edemez; fakat  krizlerin üstesinden gelebilir. Locke, anayasal bir düzende daima bir risk içeren bu yasadığı gücü bir başka yasadığı güç olan devrim hakkı ile dengelemeye çalışır.

Prerogative and Exception: Law, Sovereign and Emergency in Locke and Schmitt

Schmitt, who defines the sovereign as an extraordinary decision, claims that he cannot comprehend the nature of liberalizing politics that advocates the rule of law and cannot cope with the extraordinary situation that hampers his nature. In this way, Schmitt places Locke in a liberal legalist tradition that he thinks he designed the state as a machine. Locke, however, does not fit easily into Schmitt's generalization of the legalist liberal tradition. Because when it comes to coping with the Exception, he does not limit the administration to the extent that he thinks it is by the law; the administration arbitrates with the prerogative power. The privilege, which may sometimes involve even acting against the law, is a recognized discretionary authority to deal with extraordinary situations. This authority must be used to the benefit of the people. Schmitt ignores Locke's prerogative theory to a large extent. Despite being empowered, Locke’s  administration can never be an absolute sovereign in the sense of Schmidt’s ; but may overcome the crises. Locke tries to balance this extralegal power, which is always a risk at the constitutional level, with the right of revolution, which is another extralegal power.
