Müşterek mülkiyette paydaşlar, pay üzerinde sınırlı ayni haklardan mülkiyet hakkına en fazla yaklaşan ayni hak olan intifa hakkını kurabilirler. Bu çalışmada intifa hakkının kanuni ve akdi muhtevası, pay üzerinde intifa hakkı kurulması işleminin diğer paydaşlara etkisi, hukukumuza yeni Medeni Kanun ile giren ve 700. maddede ifadesini bulan düzenleme olan pay üzerinde kurulacak intifa hakkının “ortaklığın giderilmesinde etkisi” hususları değerlendirilmiştir. Bu çerçevede “pay üzerinde intifa hakkı kurulabilmesi” meselesi, eski Medeni Kanun ile yeni Medeni Kanun karşılaştırılmak suretiyle incelenmiştir.

Joint owners in joint ownership can use the right of usufruct which is the real right most similar with possession right among limited real rights on share. In this study, the legal and contractual content of the right of usufruct, the effect of the transaction of establishing the usufruct right on share on other joint owners, and the effects of the right of usufruct to be established on share, which has entered into our legal system through new Civil Code and stated in 700th article, on “the elimination of joint ownership” will be evaluated. Within this frame, the matter of “the ability to establish the right of usufruct on share” is evaluated by comparing old and new Civil Codes.
